If you are not actually IN possession of alcohol then you are not guilty. Your first mistake was blowing into the breathalizer. Should have told the cop to piss off. Unless you are driving you have no obligation to take one.

I was at a huge party a few years back. Had a few beers and the cops raided the party and arrested everyone. I was charged with underage possession of alcohol. I took it to court and was found not guilty because at the time of arrest the police could not only not prove that I was in possession of alcohol but they couldn't even prove that I had been drinking.

I would get a lawyer but Im pretty sure If your under 21 no matter what you blow means you fail since your not supposed to be drinking

Dont admit to any thing... first thing you need to do is go to the police station and get t he police report... see what it says and take it to a lawyer. it will cost you but it is better then getting shit like that on your record.

depends what state he was in.. some states that is true but in others you can blow any where from .01 to .08 and not get in trouble.

enjoy, i got an open container in public once for picking up a beer bottle near my car to throw away so i didnt run over it later on

went to court, the guy called before me ran a red light at a busy intersection and got a $120 fine, my open container fine for walking an empty bottle that wasnt even mine to the trash was $160:crazy:

3 Things:

1) the guy who posted "dont take legal advice from 20 yo on a caraudio forum" ya hes probably got the best advice for you.

2) Unlike the guy that said "you dont have to blow, unless your driving" That couldnt be more wrong. Your innocent untill proven Guilty, and you do not have to incriminate yourself (ie. blowing). Always refuse unless your over 21, and are 100% sure your below a .08 (if your in tx). Even then why risk it, still refuse it. Im 22 and 5 weeks ago I refused it because the only way they can force you to test is if they get a warrant out for you. Most of the time when people are drunk its late at night into the early morning. Very few cities keep a judge awake 24 hours, so the only way you would get your warrant is if the arresting cop calls the judge and gets a warrant. Otherwise the worst the cop can do is take you in to the drunk tank and make your *** sleep there till morning then release you.

3) All this blowing and blah blah doesn't matter because hes got you for posession. Lets me honest he had no proof you were holding any of the beers, and if what your saying is true then his dash cam would need to be proof of this. Say the judge just wants to be a dick im pretty sure possession is a misdemeanor and your gonna get like 50 hours community service and a $200 fine or something close to those 2 numbers.

in florida you have to blow or you lose your license for a yr.. You sign it when getting your drivers license here.. the only thing is, is that if you do blow and fail you may lose your license that way and you face some major fines

For underage alcohol possesion. Going to try an keep this short and simple.
First my buddies were drinking in the hotel parking lot while my other friend was buying the room.

Cop pulled in, buddies threw their beers and the cop saw. He took down all our information and asked if we were stayin at the hotel. We all said yes. He let us off.

15 minutes later I was walking down the street to go to another party. Cop pulls up and tells me to get in the car. Pulls back into the hotel parking lot. Makes me pick up their beers, then breathalizes me after I told him they weren't mine and he could finger print them for proof.

He said I failed the breathalizer and cuffs me and takes me to the station. I was drinking hours earlier. I asked what I blew and he said I just failed and wouldn't tell me

Then we get to the station and gives me a ticket for alcohol possesion.

Should I plead not guilty? I mean, yea I was drinking hours earlier, but I was just walking down the street on the sidewalk minding my own business. Plus he didnt tell me what I blew. (I'm not sure if they have to tell you or not) But I know it wasn't much.

Yea, but I did not have a beer when he came the first time. I was drinking at a party before. He told us to go into our room and if there was any problems he had our info. They were drinking more in the room and I decided to go to my girls house down the street.
Then he picked me up when I still had nothing on me.
