Ex Girlfriends mom hit my car...

so I decide to spend the night wuth my ex to get some //content.invisioncic.com/y282845/emoticons/crap.gif.7f4dd41e3e9b23fbd170a1ee6f65cecc.gif and well anyways, I go to leave her house in the morning to $946 (already got a quote from my friends shop) worth of damage to my car... Her mom who wakes up for work at 2am, backed out and hit my car... and of course decided not to tell me... so I woke up and saw it, knew it had to be her... but wasn't 100% sure...

anyways, the mom came out with it and told me, but she insists going through insurance on this because she can't afford what was done... Now my main problem now is that my insurance company is saying because I was driving the car and I am not the primary user of the vehicle and my mom is, that my mom's insurance will go up slightly because of this... This also pisses me off, because the car was parked there over night and nobody was driving it, yet for the accident, they insisted taking my license and info and using it... and sayin that I was responsible for my car...

Something seems wrong and either me or my mom will get screwed in the long run... is my ex's mom playin a game on us?

Also, I've only spoken, myself with her insurance company and they said if I want to avoid going to court in all of this, that I have to get it repaired at a shop of their choice... also a little sketchy, I think I should be able to go where I wanna go with it...

What would you guys do here? I've never been in an accident or dealt with insurance companies before... any help?

Also, when I was goin out with the daughter, she opened my passenger door and smoked another car... I paid to fix that other guy's car and asked her daughter to pay to fix mine... still didn't get a cent on my car from her daughter... This could turn into a big legal mess... the damage on my door pushes the total cost of body work on my car to over $1000

 
if you or the the vehicle you are driving is in an accident or is damaged by no wrong doing of your own you never contact your insurance company, 100% of it is done through the responsible parties insurance...

all you do is get their info (company, policy #, vehicle info and name) contact their insurance company and file a claim...thats it...end of story...no further calls need to be made...an adjuster will contact you and in most cases have you go to a CRP shop (certified repair program) and get a base estimate...or they may send someone out...then you take it to the shop of your choice and its over..

Who is your insurance company?

Doesn't matter who was driving the vehicle, primary driver is still primary driver. I mean how does the insurance company know that you have been driving it all along? Just say you borrowed it for the night because of XXXXXXXX circumstance.

I totaled my parents car when i was 16 due to a blown out tire, i was not the primary driver...the insurance company gave us no hassle over it.

 
was it in a driveway or on her property? if so homeowners insurance will cover it.
It was in her driveway...

BTW I did not contact my own insurance company for the people wondering, when I told my mom what happened, she called our insurance company for advice.

I also did speak with her insurance company, while I was at my ex's house, I really have a hard time with why her insurance company wanted to know all of my insurance info and my drivers license number and things like that...
