Yeah, the other parties insurance really does not have to pay short of a court judgment. If liability is clear they will typically want to settle in the hopes of doing so as cheaply as possible (this really applies when there have been personal injuries.)
But you are right, if you have comprehensive insurance then the thing to do is probably to call your own insurance, tell them to pay and subrogate your rights to collect from the third party.

They can file an extension as well. I am unsure whether to go ahead and file, then file an amended return or wait. While I don't need the money today, I **** sure expected it by mid feb.
