Yes if someone drops their cell phone and causes an accident, I think they should at least hold some responsibility. But the driver behind her should be ready for just such a situation, because a child darting out in front of the car in front of you would cause the same emergency stopping reaction as the dropping a cell phone and panicking example would.

The driver behind always needs to be prepared for the worst.
