the guys at AA arent the smoothest group of audio dealers I have ever worked with,I got my refund yesterday finally on my comps preorder...They never returned an email,a phone call or offerend any responce from my attempts to communicate. I will not bother with them again...very unprofessional.

I have tried to buy from them but haven't been able to get a hold of any product that is in stock. On the flip-side though, they have always gotten back to me, were never rude, and seem to have a great product.
I think something to really remember is that these are getting great press here on the forum and we have many many thousands of members. They are cheaply priced for most people so I'm sure they are overwhelmed with orders. It’s not easy for a small business to take on huge orders all at once and this may be the number one reason why they are having a difficult time getting to everyone.

People usually only react in the way they feel they are being treated. Were you being less than unprofessional when you were talking to them to? From the time we sent in the recones November 11th, we were told to call in a week to see if they arrived. We did, and were told " we just got them, how do you expect them to be done". So I had to explain to Dale that i spoke with Chad and he told me to call to see if they were received and he would update us on parts at that time. They said they would call us by the end of the week, no call. So we called the next week. Chad said "we're doing your recone right now! Because of Thanksgiving, we probably won't be able to get them shipped until Monday. Call Monday and we will let you know". Called Monday, they said defective parts, they have to redo it, call in a week. So we called 2 weeks later. Waiting for parts. Kat told them she was getting it for my Christmas present. (my girlfriend). They said waiting for replacement parts, call back. Called back, still waiting for parts, call back. I gave them the CC # at that time, but he said he will give me a total in an email because the computers were down. This was when they finally updated the site with the new products I think and started taking orders for new stuff. Never received that email. Kat called and asked if they put the CC through yet so we could balance the checkbook with the total. No total, not done. I had Kat cancell it, and we filed a complaint with the BBB. A few weeks later, Chad called talking trash like he was some punk selling speakers out of his garage. He hung up on me then called back. I told him if I get the subs in 2 weeks, i will contact the BBB and let them know everything was OK. Then Dale called talking trash saying it was done, where's our money. They changed the price on me. Instead of saying "sorry sir for the 4 month wait, we will lnock 15$ off each recone" they were rude, accusatory, and tried to tack on an extra 15$ per sub because the price had gone up...four months later! They talked abiut how I was weak because I had my girlfriend call. On and on, a lot of stuff that doesn't need to go here.

So here we are.

what do you mean power handling? cant take what its rated for?

oh yeah for the person who started this thread, dude... even though the recones have taken an ungodly time to do, dont sue for a full refund. Youve used and crashed them and teh want a full refund? Hell let me do this everytime some company takes a long time to recone. Some guy in your post in that other forum was saying that the recone for the brahma took forever, yes their ethics have been rocky, for being unorganized and being a small company flooded with orders. Their disclaimer and return policy is rough, you should of thought of that before buying and accept the risk. Thats life...

Hahaha, I have none to sell because i have plans for mine but I like them. I've only heard the tinsel slap when running them pretty low and hard, a little down and dirty. But for Home speaker apps they should be perfect, which weren't they designed for that? Cause that's what i got them for.

 
Sounds like people here agree with my assessment. As stated on ECA:

From reading your post on toxicforum, it seems like you're taking your "consumer rights" a bit far. I don't work for AA, nor do I have any real reason to "take their side", so this is from a neutral point-of-view.

 

1. They aren't obligated to offer you a discount for an extended wait on a recone. Nowhere on the website does it specifically state that they offer a discount if their "deadline" on recones isn't met. Sure, it would be good for business, but it isn't your decision to tell them how to run their business.

 

2. As a business, they reserve the right to change recone (or any other) prices at any time unless the credit card has already been charged. By informing you of the change in price, they met their legal obligation. If you can't accept the recone price, don't get the recone.

 

3. Their policy specifically states that all warranty claims (i.e. your Poly mids) would be inspected upon return and then they would decide if they should be covered or charged for replacement/being fixed if it was found that they were abused.

 

4. Maybe I'm misunderstanding what happened, but why are you seeking a refund for the full price of two Avalanches when you sent him blown ones to recone?

 

5. In order to win in small claims court on the Poly mids, you'll have to show proof that they were damaged goods from the factory and that you made an attempt to send them in for warranty claims which were denied. Good luck doing that.

 

6. It is your responsibility to cover all shipping charges, as stated by their policy, UNLESS they deem the product to be insufficient and covered by warranty.

 

7. People who don't know the difference between "breath" and "breathe" shouldn't be making judgments about the intellect of others.

 

 

From a neutral point-of-view, I really don't see how you plan on actually winning in court based on the claims you've made.

Actually, he could prove (somehow,I am no speaker expert) that the design was flawed. IE aa produced a product with a known flaw and marketed it as a good product. He has a few other similar options at his disposal.

Problem here is, best he could hope for is some small punitive damages. He may get a full refund but that is about it. Most small claims courts would dismiss this as petty. If it would have been alpine, rockford, etc, it may be a different story. What I would be worried aboutis libel. You have kinda accused AA of breaking a law without (what I feel from the posts) substantial evidence. Furthermore, why tell everyone, just do it and then maybe post the results. If I were AA, I would be 100x more afraid of a letter from a lawyer than a post on a forum. Lastly, all AA supposed rules are not enforcable in all states. For instance, in TN you have a guarenteed refund on all products within 7 days with a reciept. There is no such thing as all sales final.

If AA quoted one for a recone and then changed the price in mid-recone, it would be considered bait and switch. He could have said he woould do it for $20 and then charged $50. I would do a chargeback with my CC company and let AMEX hang thier *****, or just get my funds back after I recived the product to ensure they would not hold my product hostage.Send all e-mail transcripts to AMEX and they will handle it for me.

Again, I say you are stupid for posting " I am gonna sue" unless charges have been filed. AND it may be quite hard getting him to come to your state. Your e-mail and his marking plan qualifies him for "minimum contacts"...however....I think if your attorney sent him a letter, he would just send your stuff back and refuse to do business with you in the future.
