you're going to have to sue the shop's or UPS' panties off. get in touch with your lawyer and tell him the whole story and see who is at fault for all this. is it UPS' fault for mishandling the item and breaking it or is it the shop's fault for doing a half-*** job of packing the HU..? is the shop even obligated to send it back to eclipse for you or are YOU, the consumer, expected to do that? you need to find these things out and find the scapegoat so u can get your damn money back to buy an alpine... and i don't think the manufacturer is at fault for anything they are just doing their job.. for all they know, you sent a crushed HU in and claimed it was in perfect cosmetic condition... at least UPS KNOWS the package is damaged, so maybe UPS is admitting they damaged it themself but if they only pay you 100 dollars and thats all you can do about it.. then sucks for you //content.invisioncic.com/y282845/emoticons/crap.gif.7f4dd41e3e9b23fbd170a1ee6f65cecc.gif

correct i have to go after the shop my lawyer (family friend for free:) i cant afford a lawyer) its the shop not ups. i sent it to the shop and the shop is responsible not ups. i dont know how the shop shipped it for all i know they could be purposly commiting fraud on ups to get money. all i know is the shop owes me a 8445 or my money back. i did what my first post said already. my lawyer says i have to do everything i can before i actually go after them for the list of laws they are breaking.

yeah im sure nothing will come of it untill i get replies from the agencies,i think it sucks that we cant take action until we exhaust every option,good thing there are only a few options. and ive done them,i just got to have patience

 
I once bought a home audio amplifier (Parasound Halo A23), BNIB from a place in the Dallas area. I sent the money, he shipped the amp. UPS some how "lost" it, the tracking number said that the package "arrived empty". Some how, the amp "fell" out of the box, that sounds about right to me (**** UPS).

Anyways, I contacted the guy from Dallas and told him what happened. He shipped it, and until it gets to me in working condition, its HIS and UPS's problem. Needless to say, he sent me a new amp and dealt with the UPS claim on his own time.

Thats the same thing in this case. The store sent it, and it didn't get to Eclipse. Its not Eclipse's problem, its the stores and UPS's. In the mean time, you should get a new HU, you shouldn't have to wait for them to work this crap out. I say you bother the hell out of them, just keep calling them, wear them out. Hope everything works out for you.

 
oops i guess i forgot ,i also have to send a certified letter to him and the shop stating my intentions to take further action and give them every option to make this right...so i have a letter to write. not sure how to make my point without sounding like an a-hole

Who cares, sound like an a hole. Look what kind of sh!t they are putting you through, no need to restrain yourself. Just dont say something along the lines of physically threating them & your fine. Just make sure you have you lawyer check it out before you send it to them to make sure its all good.

 
i got a call today from the shop owner,he is still playing the ignorance card claiming the he sold it to his employee and the employee sold it to me. that is the end of it for him he says. I still think its his resposibility to make sure his "employees" are not running business out of the back of his store. If im this guy i fire jeremy for all this hassle,all they need to do is refund my money or replace my 8445 per the warranty . what a bunch of not nice people.

from where? i do have proof of purchase yes. eclipse and the owner have confirmed that the hu came from blazin....the only record i have of the hu now is me paying for it and the warranty card and the reciept from my local dealer when i tried to get them to send it back to eclipse....so to answer your question.......YES

 
WELL i sent one letter certifeid and it came back "he moved" second letter to correct addr was refused. so that was his last chance im calling the local police. i hope they can do something for me.
