And despite pleas from the mayor and the chief of the Capitol police force, it took over an hour to get approval.

It's been said that Trump was refusing to do it, and ultimately Pence had to give the OK.

In California, the National Guard reports to the Governor.

That would mean Newsom could deploy the Guard in DC right now if he chose to.

The Court of Appeals is not SCOTUS, and "it was likely" is not a definitive answer.

The POTUS can activate the Natl Guard in the States as the courts just confirmed. There is legal precedent - LBJ did it.
