I would have had him clarify because I actually would have assumed he wanted to keep the newest/hottest games so he can sell them to recoup not getting his whole asking price. Keeping old games no one wants would do him no good as he won't be able to readily sell them at a good price. Since he is selling the Xbox that would be the only scenario that made sense.

We both assumed we were going to pick out our own games. Neither of us clarified who were going to pick them before the transaction was completed.

His first and main interest is getting a fair deal for himself you douche. I am not saying he is going to intentionally screw you *******. However when someone proposes a deal like he did you have to assume they did it to cover what losses they felt were coming from the deal as a seller. Not to help you out as the buyer.
