I agree 110%...but unfortunately the world does not. This defense is known as assumption of the risk...which would most lilely not hold up because it is not readily apparent this type of accident would normally happen.

A smoker would theoretically have to consume nearly 1,500 pounds of marijuana within about fifteen minutes to induce a lethal response.

So based on your average strain of marijuana, you would have to smoke 1,500 lbs of marijuana in 15 minutes.
