You sure? I rearended someone and it was completely my fault. No way around it and it was my moms car. Ontop of that i was not even on her policy and they still payed for the other car that was in the accident and gave us money for the car. Twice the book value too.
Oh and if we needed it, the insurance was willing to pay up to 15 bucks a day for a rental. That's pretty weak.
that would be full coverage which your speaking of. not liability which is the case here.

Sounds like your mom had full-coverage insurance (aka comprehensive and collision), not just liability.

OP.. if the other party has been proven to be at fault by a police filed accident report, the other party is liable for all damages. This includes your car, anyone elses property involved and any medical claims.

If so the insurance company will likely be contacting you very soon. If not, you need to contact them. If you do not have any success on that front or are not happy with the compensation package they have offered you, ask your insurance agent to get involved. In most cases though it will take an attorney but at the end of the day, they will have to pay that expence for you as well.

Absurd to think you could be jeopardizng yourself by trying to call and ask them for a rental car. this should have already have been offered.

well i figured that if i called them, they might ask how the accident happen. now they might record this and if i slip and say something im not suppose to say, then they could use that against my claim and backfire on my end.

believe it or not, the police dont come out unless someone is dying out there, another way of them not giving a fuck. thus, no police report, though there was a witness.

Story: i was in a parking lot approaching a 4 way intersection alley; 3-ways had no stop signs; 1 of the ways, did have a stop sign. i ran my right of way, the other party slowed to a stop and went straight. they were on my right and before i got the chance to slam on my breaks, we cornered. had they done a full stop, they wouldve seen my truck coming from their left.

adjuster said by looking at both photos of my and the other party's vehicle, i wasn't speeding, something the other party counter-claimed in hopes of winning.

 
Did an adjuster come to the scene of the accident or just visit both parties seperately after the accident?

in that case... if no police report.. Dont call anyone except your agent and let him handle it.

This is why things are moving more slowly. The only thing both insurance companies can do is interview both parties and the witness over the phone.

I would have not left without a police report. Remember this in the future.

You should have made it clear in your first post that it is not absolute that you are not at fault.

yeah i have learned that lesson.

in the future, i will tell the cops that the other party is not cooperating in exchanging information or my head hurts.

at this point, i guess i will ask my adjust to ask on my behalf for a car rental.

 
This was in a private parking lot? Well, no wonder the cops didn't come.

In that case, there is no legal determination of fault unless it goes before a judge and he determines it.

Sounds like you may be f00ked unless their insurance company wants to play ball.
