okay so long story short, i got into an accident, and i just got a called today from my adjuster that the accident wasn't my fault.

so, i understand that i dont have full coverage, just one way; can i ask my adjuster for a waiver for a car rental? or is there a way of getting away with rental car for free from liability insurance?

your fault= you pay for your stuff and repairs and the insurance pays for the persons you hit and your rate goes up after that.
liability= your liable
okay but i the accident pictures has proved that it is not my fault so lets leave it at that.

any tips to barter with my adjuster so that he will give me a free car rental?

no, if you were cited there is not much fighting it unless your insurance company fights it. and gl with getting your insurance company to pay for anything other than the people you hit to get a rental, medical bills, repairs etc. just hope you had enuff insurance to cover it all and they dont sue you as well.

i was told that the worse case scenario is 30/70 liability on my end, so my insurance paying them 30%.

i was also told that my insurance won't go up as well by my adjuster since it wasn't at fault according to what i've claimed and there was also a witness.

would a lawyer help me get rental and medical?

It wasn't his fault. Op it's on the other party's insurance company. Call their insurance company and tell them their insured hit you and that your job involves your car and you can't go wthout one. I was recently hit and i got a rental car for 2 weeks, they still left me with no check and no car for about a week though, In ohio they only have to provide a rental until they determine your car a total loss.

No.

If your policy wasn't full-coverage, your insurance is not required to pay for your repairs OR rental car. If the other party in the accident was at fault, then THEIR insurance should be paying for your repairs AND rental.

If it was a one-car accident (just you) and you have only liability insurance, you're fooked. End of story.

my adjuster said my truck is a total loss and the damage and extensive to repair.

is it too late to ask for free car rental?

I dont know about the rental but insurance companies usually listen better when you go throiugh an attorney, But most usually charge a third of your medical settlement for their services.

i've said that it's their fault in the last few posts, and since i was told not to say anything to the other party's insurance as it can work against me, who should i talk to?

yeah that was an option. money splits 3-way for medical. but i get to pocket the vehicle's damage fee, or its value.

You should demand a rental car from THEIR insurance... if they decline, then you can get one out of your own pocket and hope to include the cost of it in the negotiations to pay for your truck. However, if you try to play hardball in the negotiating, it can drag out and you won't get reimbursed for as much... they'll claim you should have settled earlier and your rental fees wouldn't be so high.

Of course, you could get screwed and have to eat the cost this way, too.

I seriously doubt your insurance company will pay for your rental. If the accident investigation proves the accident was not your fault, then the opposing insurance should pay for your rental, at least for a short time. Calling them and telling them you need a rental isn't likely to cause a problem with your case, but if you're really worried about it, have your agent/adjuster do so on your behalf... they are supposed to work FOR you in situations like this, but most often they try to wash their hands of the whole mess, leaving you to flail around like a 16-year-old trying to lose your virginity in the backseat of a Pinto.

You sure? I rearended someone and it was completely my fault. No way around it and it was my moms car. Ontop of that i was not even on her policy and they still payed for the other car that was in the accident and gave us money for the car. Twice the book value too.

Oh and if we needed it, the insurance was willing to pay up to 15 bucks a day for a rental. That's pretty weak.

my bad, i thought you was cited. well in that case if they were cited then your entitled to get full compensation from their insurance company. your shouldnt have to pay for any of it. i would get free consultation from attourney. some are cool and will give you enuff info to handle it yourself.
