Should they be obligated to upgrade you for free ? No.
Five weeks wait time so far with another expected 3-4 weeks is long and not A+ customer service, but not god aweful.
Good customer service would have been to advise you of the wait time prior to sending in the top assembly. Though something may have happened that caused a longer-than-expected wait time to receive the parts.
Do I think they owe you a free upgrade? No, not at present. Would it be great customer service for them to do so? Yes, it would.
