Alright, well he SHOULD have read you your Miranda rights then. Seeing as nothing was found/proven from the questioning all this will amount to is a slap on the wrist for the officer. The only time them not reading your rights would directly impact your case is when they find something further from it, so say you admit to having weed stashed in the center console, they wouldn't be able to use that as evidence because they did not read you your rights and the evidence would be thrown out. Since they found the paraphernalia without questioning you though, that will hold up.
I haven't caught up on the 2nd half of this thread, but my question is: What was the probable cause?
I know the cop said he looked nervous... but I'd have a hard time believing that's probable cause. Neither are air fresheners. It sounds like the cop just had a hunch to me.

he asked if there was a weapon, he never asked if he could retrieve it I actually was going to hand it to him and he said no no no he would get it but he was already snoopin through stuff he had my passenger side door open and was lookin through my wallet that was in my cupholder with my cell phone which he grabbed and was holding on to.. i never gave him any type of permission to open anything or grab anything this cop had just pulled up to the scene 30 seconds before this and started going through my car

Sounds pretty fucked up. I'd contact a lawyer. It sounds like they really did just about everything wrong. Lost personal belongings. Didn't read miranda rights. Didn't ask permission for anything. Didn't have reasonable cause for anything.

First mistake was telling him you had anything in the car. That is pretty much all he needs. Next mistake is not locking the **** doors when you got out. Next mistake was not demanding they GTFO of your stuff when they attempted to go poking around. "I do NOT consent to you searching me or my property".
Ask if you are free to leave, if they say yes, leave immediately, if they say no than you are under arrest. At this point you must demand your rights (attorney, silence, etc.).
tldr: You gave what passes for consent these days.
What they did was pretty much standard police procedure. If you don't know your rights and don't understand how to stick up for yourself you will be pushed around like bullies like that any time you come in contact with them.

I've been pulled over plenty of times, speeding, expire registration, loud music, worst ive ever gotten is a few tickets and a few warnings. Theres always 3 sides to a story yours, the cops, and the truth, so yours honestly really isnt going to matter since they found what they did

You could have just gotten a shady cop too. When I got busted it was the same cop that had been trying to get me for almost a year. He would come out to where I work and get permission from my boss/owner of the property to search the property and they'd come go around my car with the drug dog like 1 or 2 times a week. When I got busted he took 400$ I had in my wallet and said it was drug money. He didn't even put it in a envelope. He put it in his pocket right in front of me. But when I asked the judge how to get it back, she said they never had any record of taking my money. So he kept it. Also when he searched my car, he broke my I pod, and he also blew my amp cuz the power and ground touched somehow and shorted out. So you might have just got that 1 cop that is the total p.o.s.
