could you not have waited in your vehicle untill you sobered up instead of puttig our lives at risk by driving drunk?

QFT! Many options here.. You endangered how many lives of innocent people by driving an hour drunk? Sleep it off in the car, Hotel etc.... Yes, your friends ****, but you could have destroyed a family with a poor decision.

In TN, if keys are in the car and you are drunk in the car, it's a DUI. Where in the hell are you going to put the keys? I guess you can put them on the ground outside the vehicle somewhere. EVen if you are in the backseat, it's still a DUI.

now, that is a law that can be beaten in court by a competent lawyer. What you say IS: Your sober friend is driving you home, and he gets pulled over. Now, you are drunk elsewhere in the car, so you CAN get a DUI because even though the cop didnt see you do it, he is allowed to ASSume you were driving at one point during your drunken state.

That is pretty much the point. Also, if you are very drunk and allow a less drunk friend to drive you home, both people get DUIs.

I guess I should have clarified...if it is your car. IE, you let your friend drive your car.

There is also a law against non-drivers drinking. That is the dumbest of them all.

Me and you go to a party. I have 10 beers in an hour, you have 3. I drove, but now I am too drunk. Therefore, you are going to drive us home. If you get pulled over and blow over .08, we both go to jail for DUI.

I understand the law, but the passenger made the conscious decision that he cannot drive. All the passenger has to say is "I thought he was sober" Since he is ADMITTING he is drunk, his judgment is already questionable, therefore the prosecutor would have a hard time convicting you if you had a lawyer worth a dammmmm
