hey i had the same thing happen to me but it was alittle diff . i need a few surgeries and my car was paid off. i got a check for what my car was worth . that took like 2 months and i got a check from the accident wich took 7 months. i was out of work for 14 months do to what happen . u just have to get a car to get around in my case it was to dr and thearpy etc. just take it easy and dont b like im gona get this amount or that amount its gona **** when the lawyer takes there fee. boy was i pissed i seen a nice big check then i had to sign it over and i got a nice amount but it was not a new bmw like i was thinking of geting. yup

I already talked to the attorney and I'm completely prepared for what I have to pay him =]

i sent you a pm there is more to that. dr fees more court fees if you get lets say 20,000 u go to court and u can walk away with 10,00 the guy you try to take to curt will not pay a dime or less he has$$$$$$$$$$$$$$. sorry just take the check u got a pm . i went threw this not to long ago and i was hurt bad real bad bro i should not b here right now.

I'm not suing the guy yet, I might just sue his insurance company to start off.

But I also have the option of calling the guy himself and letting him know I will be serving him very soon to scare the crap out of him.

Like I think I said earlier in this thread, that is exactly what my layer advised me to do. Id been waiting almost 10 months for the other person's insurance company to get off their ass and actually pay me the undisputed amount we all agreed to. Once I finally made the call to the woman that id be serving her with the paperwork to sue her, personally, the claim was settled LATER THAT SAME DAY (coincidence? I dont think so) and the check mailed to me that week.

Good luck man, I know this waiting game sucks. If nothing else, the insurance company will hold onto the money as long as possible to keep collecting interest on it.

Did you sign away your right to sue for medical damages? Like I said before, this is the biggest concern the other party's insurance company has, and no doubt the first thing they pressured you to do was sign a medical release of liability.

Nope =] I only signed away rights to my car so far =] I got a whole bunch of bills in the mail in the past week =/

The total for just the first day of everything meaning ambulance, cat scan, drs, and first meds is about 7k =S

I was uninjured in my accident, so Im treading on unknown ground here... but I suspect you wont get paid anything until the entire claim is defined (as in, you probably wont get paid for your car until the insurance company settles with you on the medical bills as well). Your lawyer should be able to answer that question for you.

Oh no I already got paid for my car =] That has a huge clusterfack though, as you would imagine.

But it will be a good while until most of my medical bills settle down and I can finally get down to business on that half of the claim.
