Shipping

The shipper took $400 for insurance, so does that mean he gets to keep my original $375 plus an additional $400 for a total of $775, then I do not get anything?

 
He paid to have $400 worth of insurance through Fed Ex, I am on the phone with them right now and they said they will process everything through him and issue him the money, then it is his responsibility to reimburse me, basically I am getting screwed there is no protection for me as the buyer, even though the shipper has my money. He offered to give me the claim, I do not want the claim, I want my money.

 
I guess they said it could take 6-10 days, the claim was filed as of the 6th. Allegedly he has been given the fax number to send a document to allow fedex to reimburse me directly. The only thing that still scares me is that if the seller does not have proper documentation then they will not complete the claim and I am again screwed, I am not sure what kind of documentation he has. Just sucks because right now I am the only who is out anything.

 
You are saying you are screwed because he has your money, but he has already told you he doesn't have the money anymore. It isn't his fault FedEx messed up. It's a great thing that he had $400 insurance on it, and once the claim is complete you will get your full refund. It's a PITA to have to wait, but it's better than getting ripped off $400 from a scam artist and never getting it back.

I have no idea what approiate documentation is, they were saying because it was done through paypal that it might make things "complicated".

 
He should pay you when he gets it.

This type of situation is what will kill Ebay and the like.

If you paid through Paypal, then he just has to show them the transaction.

He could right up an invoice as well if necessary. They will probably also want to know how much the item's retail price.

Shouldn't need much documentation really since it's obvious FedEx is at fault.

 
msrp is $959 according to IA's website. I know it is not the shippers fault, but man I feel like I am totally up to his and fedex's mercy and there is nothing I can do.

One thing you can do is be patient. They have tons of claims like these everyday. It might take a little while, but they should get it right, especially in this case. They really don't have an argument. It's their fault.
