reading back, yah, i admit, i worded it wrong, that the site is not private owned. n i was saying that it's not the same as stepping onto someones physical property. it's public access, and when you create a site, you choose what to put in the TOS. in fact you could put "i agree that some people like jelly beans" and slip by with it. what i am pointing out, is that there are internet laws that you could not legally bypass, and all it takes is getting caught. on some other sites, it is safe to bypass some of the censorship legally, by making it a special membership section. one site i've been on for years, my premium membership allows me into such a section, and lude behavior and topics can reign freely. you must agree to certain tos for that privilege, similar to accessing different xxx sites. when you start a forum, you agree to your own tos that you will not break any internet laws, in short, and that is as far as they look into your site, for the most part. i suppose, this doesn't have much bearing on the matter anymore, since, it was put plainly that goob doesn't want this, or that, and that's the final word. i was just trying to point out that his liability is real for more than most will know. not that he is definitely just "playing god"
