picture of PS3 sold for $840 on ebay!

2 things:

1. What PhatTony did was fraud. His intentionally mislead someone into purchasing goods.

2. His avatar is a **** what else do you need to know? lol

 
its not fraud. it SAYS what the item is. unless you can explain to me why selling a picture of a playstation, that is noted as just that in the auction is fraid....its not fraud.

A court would easily see based upon evidence there was unjust enrichment on the promisor (seller). this contrat is voidable. end of story. the contract was formed (the auction decription) with the intent to defraud a consumer of $. Hence, the equitable remedy in this case is restitution for the promisee (ignorant consumer). All these circumstances come into play if the buyer does not pay...or pays then immediately files an action in equity.

I appreciate your concern for the PS3 Ebay auction. After printing out the winning auction confirmation, I noticed there was small print stating that this item was for a picture only. I then contacted PhatTony through email confirming the auction. He told me that yes this auction was for a picture only and refused to refund the $600. I then found an old Ebay auction where he listed his cellular phone. I called, asking him to once again refund the amount and all I heard was silence after a few first words?I was being nice!

I then searched his email address on Google and found the Car Audio message blog. I began monitoring all activity on this site since yesterday evening and saved it. I will be contacting an Attorney if this issue isn?t resolved within the next few days.

Thanks again for the support. We live and we learn but Karma always has a way of catching up with a person!

geez, sometimes I wonder if people dont have any morals anymore, theyre just greddy bastards! although how different is this auction from what many large corporations do? they say buy our product now and you wont have to pay for it for 2 years, interest free!! then the third year rolls around and the interest is 20% on the balance, then ppl get screwed over b/c they didnt read the fine print, this is just an example but it happens all the time, theres a saying i once heard,"Theres a sucker born every day!", not that that makes any of these auctions "alright" but its tough to condone them too, it is printed in the description the auction is for a picture only, same font, same size etc, too bad someone cant read, o well, flame on then, Im sure Ill get flamed for my comments, so be it . . .
