Yes, that is an act of god. How is it not? A storm, took down a tree branch.

Now, Your best bet is civil suit. However, anything that overhangs onto your property, can be taken care of by you. If his tree is rooted on his side, and the whole thing grows onto your side, you can cut every ****ing peice of it down that is on your side.

Since you seem like you knew it was gunna happen, you should have just taken care of it your self. But go to court, and try, if you tell the judge that its happened before and youv asked and asked him to take it down, the judge is gunna say, "well why didnt you cut down the branches yourself"...
