I got into a car accident.... Think I can sue this guy?

I've come to know and love you guys here, so I figured I would ask you all for some advice. I got into a car accident... Do you think I could sue the guy?

I was making a left turn, the other individual was making a left turn from the opposite side of the road. We both started to turn at the same time. I saw him and stopped, he wasn't paying attention and continued to accelerate. He ran into me. A large portion of the front of my car is damage, including the AC radiator, engine radiator, frame of the engine bay, engine bushing, and the entire bumper assembly. The police at the time said no one was at fault, and that we should pay for our car's damages individually. However if the other driver was paying attention and stopped like i did, the accident would not have happened. BUT the police report doesn't reflect that...

We both had stop signs, no traffic lights.

The police report states:

"Driver of V1 [me] stated he was making a left turn onto route 30 from dill avenue when he collided with V2 [him] just prior to the double yellow line. Driver of V2 stated he was making a left turn out of luciens manor onto route 30 when he came into contact with V1. No reported injuries at the scene.

*blocks 118A 119A indicate both drivers were innattentive."

It does not clearly say I was at a complete stop when he hit me... Would I have a chance in a small claims court? Or should I just pay for this out-of-pocket ?

 
nope with blocks 118A and 119A indicate both drivers were innattentive....that indicates that you cannot sue....as police report will be brought into court also. You get screwed by the Long arm of the law.

but yeah you should have told the cop you saw the other guy and stopped. with what he wrote out, you are both at fault

Umm are you sure you have the right forum.....

Your screwed tho, small claims is just going to refer to the police report which says you both were "innattentive". Even if you say you stopped, you stopped with your car sideways on the wrong side of the road, wheres your case?

 
Why in the world would you let the cop file the report with that wording, assuming the story you told us is true. The law didnt screw you, you screwed yourself. My guess is you were afraid to stand up for your side of the story in the face of the cop and other drivers. Lesson learned I hope.

He was driving an 07 e63 mercedes.

My piece of crap mazda's unibody is twisted up though.

He's going to sue you.
It happened a month ago.

But the police station the officer referred me to was apparently condemned. Eventually I asked the people at the post office how the hell your supposed to get a hold of the police department, and he said they have a shanty set up behind the King of Pizza down the street.

I haven't heard from him yet. (the mercedes driver)

 
its a dbl yellow line. you can not cross a dbl yellow. Thats why you both fail. Even if you were stopped, you were going to make an ilegal turn.

I only have your pic to verify that.
