That's my point.... paying off the family doesn't absolve you of the crime. And I don't agree that killing someone is a crime only because people close to him suffer a loss.... it is a crime to kill someone through intent or criminal negligence, period.
For instance, if Lil' Wayne were to come to my hometown, and I popped a cap in his dome, would it be a crime? No one on the planet cares about Lil' Wayne as a person or a celebrity, I mean seriously... if he died, it wouldn't hurt anyone at all... even his own mother thinks he's a douchebag, and she'd prolly be happy 'cause then she might get access to his money. So could I walk free after doing it?

would it not be the fact that you took a life? fuck the family, you took a life. that is the crime. not the fact that you hurt the family. that's the effect of the life being taken.

 
It is a loss to the person who is killed. What if someone killed you and you didn't have a chance to grow old, have kids, nail *****es, etc.? I'd be kinda pissed if some drunk-*** fool ran me down... regardless of if anyone else was sad I was gone.

There is no mechanism to compensate the victim for his loss. I don't think there is any legal system in the world that can compensate a homicide victim for their loss. If I am dead, I don't see the difference between me getting hit while walking in front of traffic vs. a heart attack vs. the other ways in which one can die.

It's a crime because by killing someone you have taken away their right to live. If you take away one or any of someones right you have committed a crime.

 
Killing someone with a gun is murder thats a little different then manslaughter. He didnt get of easy. I had a friend who was killed by his father that ran him over while drunk and he got a similiar sentance.
In my opinion killng someone while drunk should be murder no mattter what. I have a big problem with people that drink and drive.

People who are on trial for murder plead down to manslaughter all the time if the states case isn't strong enough to get a murder conviction. It is not as easy as you would think to win a murder case.

Murder requires the intent to kill someone. When people get drunk their judgment is altered and they are not fully aware of what they are doing so it's hard to get a murder conviction against them. Our criminal justice system is designed to protect the accused and that's why a lot of people are able to get off especially if you have money.

It's not about compensating anyone for the loss... that's what civil cases are for. In the case of a criminal complaint, it is the state stepping in to speak for the victim (in this case the dead man), asking for justice, aka punishment fitting of the crime.

By your definition, the murder of a homeless bum with no friends, no family, no contribution to society is ok, because no one will miss him, and he can't speak for himself once he is dead.

Murder is not related to the perceived worth of the victim...

does Micheal Vick get over a year in prison because of animal cruelity, and Donte Stallworth gets 30 days in jail for killing someone under the influence?
