got backed into, got questions about insurance

I love lamp.
So I have an 03 silverado with full coverage, while I was at work some lady backed into me (90's 2dr explorer), she has insurance, I have insurance, but my policy JUST renewed (like 2-3 days ago) and I was out of town so I couldn't stop in and pay it, if I do decide to file a claim against her insurance, will I get in trouble because my policy renewal didn't get renewed? I know I shouldn't be driving around like this, but I actually called my agent 2 hours before the fender bender asking him if he could take my payment but he said he had already closed. So what kind of situation am I in? Should I just let her go without her ins payin for a new bumper because of my policy situation? Or because I wasn't driving (wasn't even in the truck) and it was %100 her fault, could I file a claim and get my bumper replaced?

I called the police department and they came by and made a report on it, the dent in my bumper is about as big as a post it fyi

 
Since it was her fault it doesn't matter that your policy had renewed. Regardless make the payment , but def have her insurance take care of it. When it is not your fault, and they are completely at fault, and you have filed a police report, it doesn't matter on your end.

So in short, yes, have her fix it, and no you won't get in trouble.

2-3 days is not much

I forgot to pay mine for 20 or so days once, cant remember why but they said I was covered even though I didnt pay. I have Texas Farm Bureau. They have always been bad ***

its through "farmers" insurance, something like that. I think she tried to hit me and run, because some guy came in asking who drove the blue truck and I went out there and she hit me then pulled forward/turned like 40 feet and was in the roadway/aisle of the parking lot. Then told me she didn't have insurance (cop told me she had valid ins thank god). The damage isn't bad at all like I said, but I went ahead and had it documented with the police report in case I do decide to file a claim with her ins. But the guy who came in telling me she hit my truck said he works at a body shop and said it'd be $800-900 dollars to fix the bumper, does this seem ungodly high? I was thinking id like to get a welded in rollpan at that price, would that be ok?

 
it makes no difference as its your property.. if you slip in fall and break something in a restaurant they will pay even if you don't have health insurance simple as that.. same as if she ran over your mailbox hit your garage door w/e.. doesn't matter it was a vehicle.. Even if you were driving you would get a ticket but if she was at fault I am pretty sure she still pays in that situation aswell

 
so my deductable doesnt mattter?

Im hoping to get a welded in roll pan out of this, any thoughts as to whether or not most insurance companies would let me do this?

 
she could say you rear ended her car then your insurance companies fight for months

happened to me before and case still isn't closed and accident happened in march 09

although mine caused nearly 10 grand in damage

 
One claims adjuster told me:

If you rear-end a drunk person and your excuse is 'he was drunk,' then you don't have a case, it didn't matter that he was drunk, you rear-ended him/her.

Same thing applies here, She backed into you, it doesn't matter that your payment was a few days late.

there is actually a flaw here, the 2 are not a like...

as a 10 year adjuster, I will just go ahead and say that if you are filing a claim with her insurance, it's over, done deal, you don't even need to have insurance...what would be the logic in you being required to have insurance if you are filing a claim with the other persons carrier?

any who, file the claim with their insurance and call it a day...

btw, call the cops next time and get a report, for any and all damage you plan on claiming...if I go to court on a case like this and you didnt call the cops, your *** is losing, guaranteed...I don't care how much of a victim you actually are...
