eBay- Paypal/Money Order problem

OK here is the thing. I placed an order for the chrome kit about 5 days ago through a member on eBay. I sent him a money order out for $275. He got it the 8th. I expected it to arrive today since he said that right when he gets the money it will be shipping it out and he lives in Florida, too. I just emailed them and asked if he hadn't shipped out my item if he could send me my money back since I regret buying this kit and I need money right now for some thing else. I asked him to send it through paypal....This was his response:

We just got the money order on March 6th. If you want this canceled we will send back the money order, but we can not send it thru paypal since you did not pay with Paypal.

 

The item has been delayed and will not be shipped until March 27th let us know

I think it's ****ed up that he list some thing on eBay that he doesn't even have in his possesion. I kind of understand him not sending me the money by paypal since I paid money order but would it really be a problem?

What's the problem? You don't want to buy it and he's offering to send your money order back. It sounds like you're lucky he didn't have it in stock. Just take it and stop *****ing.

I just wanted to know if you guys were in his situation would you send the customer back his money by Paypal? Why or why not?

Yeah same here. Thats why I am worried he is going to take forever to ship my money order back. This is why I asked him to paypal it back.

No because he would have to through the trouble of going to cash your m.o and then paying you back on paypal when you have done nothing but waste his time

I would send your money order back. In order to send it through paypal I'd have to go deposit the money order. Just be glad you're getting the money back.

Yeah I am glad that I am getting it back (hopefully)...we'll see. I just got an email from him saying it will be sent out on Monday so I should get it on Tuesday.

Dont the ebay rules give a seller a certain amount of time before they have to ship the item out?

And why would he refund you in a way other than what you paid with?

I think they have 7 days to send out before you can open a dispute. I bought this on March 5th and he is telling me he won't have it in stock until March 27th!! Thats BS. Thank God it's nothing major like an amp or some thing. Anyways, he is supposedly sending my money order back to me on Monday.
