He didn't choke, nor did he body slam anyone. Grabbing someone by the neck isn't choking them. Taking someone to the ground who isn't complying with the law isn't body slamming either...talk about an exaggeration.

if that area is anything like where i live there are signs posted everywhere that say no skateboarding so yes he was doing something he wasnt supposed to.

now should that cop of reacted like that no. seemed to me the kid stopped and was being respectful. some of my friends when i was 14 woulda told that cop to lick his ball sack. you know that wasnt the first kid to get treated like that by him either, just the first time he got caught. probably just pissed he had to drive around in that golf cart. pissed he didnt get a real cruiser. guys at the station probably harass him all the time so he has to take it out on little kids ha ha

i thought cops were only allowed to take physical force when they felt threatened? youre telling me that kid intimidated that cop in anyway? lol ur just as much of a duchebag as that cop is.

If the kid didn't listen to him he should have arrested him.
I actually think that is a law, non-compliance or something like that. Too much Tort Law and International Criminal Law has crowded out a lot of the domestic laws. However, he did not arrest the kid, he assaulted the kid. The assault is the issue.

The issue isn't that the kid is a smart ***, or a jerk, or whatever you want to call it. The issue is that an adult, a police officer none the less, body slammed a child after choking him. If that isn't use of unnecessary force than I don't know what is.

If he was arresting the kid and the kid socked him in the nose I would say the officer did nothing wrong. However, as far as I could tell from the video the kids were of no threat to the officer and the officer was simply trying to question them, if you wanted to put it like that but lecture fits the bill better. The kids weren't read their rights, the kids weren't going to be arrested (most likely), they were just getting a lecture from Super Cop. So his physical actions are no different than if joe smo came up and choked and used force against them.

What is especially disturbing is the officers face. That man SERIOUSLY needs some anger management and should be carrying a weapon of any type. He could have just of easily took his gun out and shot the kids. Now wouldn't that have made for a hell of a headline?!?!?!?

There obviously was NO threat to the officer...

The kid was scared shitless. Look at his face in the video when he is being "moved" to the ground, since being choked and slammed is exaggeration. (But, to me I would call that choked and slammed.)

There is a reason a 17 year veteran would be driving a golf cart on the harbor. I bet they find that he has a history of behavior like this or generally aggressive behavior.

As far as i know, they don't have to read you your rights anymore. I know when i was arrested i was never read any rights. I think they waived it to where they don't have too.

Miranda Warning?

Unless there has been a new ruling in the Supreme Court the 1966 Miranda v Arizona still stands...

Maybe someone could correct me on that and tell me the court case because I would love to look at it...

Actually you only have to be read your Miranda rights if the police are going to question you. You could actually be arrested, booked, sentenced without having the Miranda rights read. The prosecution just can't use anything you say against you and the police can not directly question you.

I think it is in Dickerson v. United States.

i know sometimes they can get away with asking you something like "are you aware of your rights?" and if you say yes that constitutes the miranda warning i believe.

but i mean in this case the kid wasnt being arrested so that didnt have to happen. honestly the kids could of walked away unless the cop was trying to write them a citation which it didnt seem he was. just looked like he wanted to be a hard ***

Actually the "are you aware of your rights?" question had been overturned in a case in the mid 90s. But, for the life of me I can't remember what it was...

Anyway, the argument was that without fully explaining and making sure the person was clearly and cognitively agreeing to wave the rights which they clearly and definitively understood the Miranda was violated. The thought was that if someone was under the influence or uninformed of the rights that they could not willingly participate in the agreement. IIRC, there was also a big thing about duress and other forced confessional things.

But, I do know that a lot of police organizations have a mandatory policy for their officers to recite the whole thing. In many cases after each line they as "do you understand". This pretty much closes the loophole for mistakes which defense attorneys are so good at finding.

a shove is now police brutality?...do people honestly not understand what happens if the police give you a direct order and you disobey it? HE WAS TOLD TO SIT DOWN AND SHUT UP HE DID NOT. the police officer made him comply. that is all end of ****ing story.

my crim pro professor would laugh at some of the posts in here. Miranda v. Arizona is an afterthought right??!! It's a bit disturbing how people can justify the actions of this officer. If you acted in that way at any other job, you would be fired on the spot. It was a simple situation escalated into something much bigger than it needed to be.

you can pick apart the actions of any person at any given time, that has been proven fact many times.

the fact is the officer gave him an order, the kid was breaking the law, the kid did not listen so the officer made him comply. end of story.

and to whoever said police can only use force when they are fearful of their life is a crock of ****ing shit, they can use force when it is necessary todo so. Verbal commands have a limit and its usually either 1 or 2 warnings and thats it. end of discussion they will make you comply.

The Miranda v. Arizona was an afterthought for sure. Just an extension of the 5th amendment if you boil it down.

Anyway, the Miranda really doesn't have any function against true nature of the thread. I only mentioned it because someone said something that related to it.
