Anyone know anything about lawsuits in small claims court

I bought some fiberglass fenders from a guy and the tard shipped them packaged in a black trash bag. No bubble rap, no nothing, just the trash bag. Needless to say they were damaged. He made a UPS claim. So UPS comes and picks up the fenders to inspect them and pretty much laughs at the packaging. They ship the fenders back the the seller. So now he has the fenders and my money. Paypal wont do anything since i didnt buy them off egay and i did receive them. Just broken.

Someone told me i could sue him in small claims court, since he lives like 10 hours away he prob wouldnt show up for the trail and i would win. Then i would have to sue him again to get his wages garnished. Does this sound right.

Not positive, but pretty sure you would have to file the claim in his state of residency and travel back and fourth to the hearings.

You can sue them locally, since it was shipped to you. But it's $100 for the paperwork to get it started and you might not get that back even if you win.

UPS had no idea what was in the bags, or how fragile the contents would be. They are not responsible for poor packaging. So long as the packaging fits their loose rules, that are there mainly to ensure ease of shipping more so thn content protection, then it will be accepted.

Call UPS and confirm this. Hell they might even have some info for you on how to reclaim your money from the shipper. Im sure they see this crap all the time.

You don't have to sue twice to get the money. You sue, he doesn't show, you win (you must still prove to the judge you have a case worthy of a judgement). Then you have a judgement that you can give to a collection agency. There is usually a form right there in the court house to get the collection agency to file.

You can't garnish his wages. It goes on his credit. The collection agency may call him a few times and send some letters, but it's the credit hit that hurts the most. He can't get new credit cards or loans until he pays you off. It may take a long time, but usually most people will pay it off eventually because it's such a pain in there *** to have their credit ruined over such a small amount.
