You can click the link to the forum post to see how many potential customers you lost. They would like to speak with you actually. Had you replaced the lug and apologized for the mistake and do your best to correct the mistake, we wouldn't have a problem. I'm sure I could easily reverse everyone's opinion if you quickly correct the issue at hand, I'm the voice of the people regarding you right now... if you want any customers you have to get a resolved status from me ;-) That includes an email of apology for what you said about my mother.

He called my mom on her cell and yelled at her, she yelled back and brought her lawyers into it, he said YOU KNOW WHAT? YOU'RE A STUPID B1TCH WH0RE and my mom hung up. I don't even want tell my dad in fear he'll go up to Utah and kick his ***.
If this is 100% true, call the cops now! That is verbal assault, especially if he called back after that. Its all fun and games till somebody starts crap like this. No need to even record the calls to file a report, you and your mom are both witnesses.

This is far out of hand now man. I'm sorry to hear your having to deal with this crap.

 
Heres the legal side of it.This would be a small claims matter as it is under 5000 dollars much like you see on TV with judge Judy and Joe Brown.

In court-

Its your word against his, as to what was said during the phone call.

A party has the right to contact the other party to try and collect moneys believed to be owed (weather they are mistaken or not).

If possible-

Record the telephone conversations.

Keep the phone records in-case he denies calling.

Immediately report any threats to the police to make public record of it.

The amount considered to be "small claims" will vary by jurisdiction. It just so happens that the folks on TV have authority to award up to $5k.

Thanks, we're just afraid if we initiate any action that he will really sue us... he sent me an email with a screenshot of an eBay invoice where he charged someone sales tax.

Seriously he must have something wrong with him. Sane people here, please answer this: If I do not make a transacation through eBay, am I subject to the auction's terms? The only way the auction played part was it's how I found him and the rims in the picture are the ones I asked for.

Part 2 of that question: Do you see any mention of sales tax on the auction besides the 6.6% or whatever if shipped to Utah?!?

What can the police in Hollywood, FL do RE: some idiot out in UT?

You should spend some time on the web page adding links to the tax code and any other factual information you've acquired. Hear-say and accusations (like "I think his business isn't that great") don't hold water, but seeing as how he is clearly in the wrong, the appropriate amount of valuable information, reinforced by his very clearly crazy responses and logic, will support your position well.

NOPE

You are subject to the terms of the contract you had directly with the seller in your direct communications. Ebay, for all intents and purposes, has no bearing at all on your transaction at all in either sales terms or sales policy. It was strictly a private party, off-ebay transaction.

What the ebay auction states is irrelevant since you did not purchase the rims through an ebay auction.

First off, if he's not able to file taxes in your state (i.e. taxation-licenced business in your state) he doesn't have a way to pay your state's sales taxes. HE DOESN'T HAVE A WAY TO PAY THEM (he can't just mail a check to Florida saying "thanks for the customer"), therefore doesn't have a reason to charge you (or anyone else) for them. Someone who has paid, simply buckled under his false threats and paid up to eliminate further conflict. The money went into his/someone's pocket -- NOT the IRS.

As for the auction terms, see item #1 -- plus, this was not an eBay auction so not even their bone-head rules apply.

Thanks for the response... yeah, thought I was going crazy for a second, his replies have no thinking involved whatsoever. Even on the phone, I yelled at him about the whole eBay not being relevant and he said it's his main evidence against me, what an idiot.

Post your emails that show the contract (agreement) between you two on your website...thats your contract, not ebay.

I will try to dig up the actual laws behind that article I posted earlier. He has absolutely no right to tax you if your out of state, it doesn't matter if his ebay auction (which doesn't even apply) says he charges out of state tax. The liability of online sales tax belongs to the consumer not the seller.

I'll see if I can dig up the actual laws behind this not just an online article, I will try to verify his Business tax ID if I can find somewhere online to do that as well. If he doesn't have a Business tax ID I believe it is illegal for him to collect tax even in his own state, which might explain why he is paying tax on the product when he buys it, he doesn't have a business license to show the manufacturer so they don't charge him tax.

My father and I used to have a business license for some of the stuff we did and that was required when we wanted to by products for resell without paying the tax.

ps...if he does try to sue you, I will be the first to pop you some money in paypal to support fighting this d1ck. May not be much but its help.
