I just left the place I was working for the past 5 years, I thought on good terms. Today I got my 1099, and was absolutely floored. My former employer actually sent me a 1099 for DOUBLE the amount I made. I have my records, and I know for a fact that all records at the shop are destroyed weekly. How do I go about having this jackass audited? I know if they audit him, they'll find no records at all, even though it's required by the state to keep records of all transactions for a minimum of 3 years.

I'm freakin out here. There's no way I'm paying taxes on that kind of money.

Sounds like maybe they made a mistake???

Call a CPA, and you might need a tax attorney. Seems pretty easy to disprove, the requirement would be on their end to show that you got paychecks for a certain amount and that they were cashed. If they don't have records, then you should be off the hook, in my mind.

maybe it was a mistake. They sent you your co-workers 1099 who made x2 as much as you.

Isn't a 10-99 a form for cash disbursements, and then he wouldnt have a paystub?

I think the form he really means is W2.

I recieve a 1099 from the sale of stock, and a 1099-DIV from Dividends.

usually a 1099 is given when you are a subcontracter, resposabile for your own taxes. The employer just fills out what he paid in wages gross, and the 1099 holder is resposabile to pay the taxes.

Really...learn something new every day. I thought that "subcontractor" label was for professionals like accountants and physicians. Furthermore, I didn't know they received a 1099. So, is OP responsible for medicare and social security as well?

yup, it's a 1099. I got paid in cash, but he is still responsible for keeping records. There's no mistake, 3 people left last year and all 3 of us got seriously inflated 1099s. He thinks because we're gone, we'll take the brunt of his IRS debt. The way tattoo shops work is we keep 50% of what we take in. The owner gets the other 50%, so his income with 6 artists is incredible.
