Anti-Weed Thread

I moved out of Cali 2 years ago, but when I was still living there the federal versus state law thing was still contested. It didnt happen like every week, but it wasn't uncommon to watch the nightly news and see where DEA agents raided a state-legal, tax paying, marijuana dispensary, and confiscate all the product and records. Usually the dispensary would be closed for a couple days, and then reopen again once the product and computers were replaced.

My impression was that this was simply the federal and state govt's playing a posturing game. I dont know if I would call that the federal govt 'enforcing the law' as you guys are arguing about, but the fed definitely hasn't given up the fight in Cali (or hadn't as of 2 years ago). The federal govt outlawing drugs has always been an argument over state versus federal rights. Its pretty well defined that the state is suppose to have that sort of specific power, not the fed, but the fed has wormed its way into more power over several decades, but now Cali (and several other states) are fighting back. Its quite a political/legal mess.

State power doesn't exist...It really doesn't matter what your talking about, federal law seems to always trump state law.

yeah but the state chooses to enforce federal law. so in cali's case they just lax'd their enforcement and put the load on the feds. which means they can only go after the bigger ones due to manpower and funding.

Federal law does trump state law. That's not the point. The point is the federal govt wasn't, imo, intended to have the power to make such a law to begin with. That is what the states and fed are posturing over.

Yeah man I understand and agree. I was saying Federal law trumps state law because I love the government or that's how I want it to be, that's just the way it is now. I think the states should have more power....
