What to do with my defective xbox 360 rechargeable battery??

I bought a new red controller with rechargeable battery kit for xbox 360 like more than a month ago

and ever since I had to keep it plugged in with the usb cord since the battery would not keep any energy at all.. after one minute of unplugging it, it would die and disconnect my controller..

I just tried it on with my black battery pack from my other controller, and it works perfectly so i just confirmed that it is the defective battery..

so I was wondering if you think microsoft would replace my battery for free or i am f*ucked?

Grab a new one off ebay from china for like $6 shipped, thats where i got my white one for my controller and it works great and its a Xbox/microsoft product.
