While I find your particulkiar case worthy, I don't agree with the government ordering smoking bans in establishments. In goverment building they can, but who the **** are they to tell a business owner that his patrons can no longer smoke in his/her establishment? I understand your argument of having to breathe other peoples filth. You can most certainly chose not to give that business money by going in though. I could care less about the smokers rights either, as I don't smoke. I am defending the owners right to say what happens in his/her facility. Even the viewpoint of the non-smoking employees breathing the smoke s irrelevant. No one is putting a gun to their head to work there. The goverment has no ****ing place to tell an owner what can be done in his/her business that is my only argument.
In your case though, my view is totally irrelevant. What makes your case worhty is the fact that they put up signs saying no smoking. So now you as a smart consumer made a concious choice to go into the restraunt believing you were safe from smoke inhalation. Even if there wasn't a law on it, you are 100% in the right. If they make policies and post them, then they MUST enforce them. I applaud your efforts in putting them in their place.
