I can answer that question better than 99% of the members and cite reg refrerences.

The answer is, it depends. There are mechanisms available. But technically, unless Congress has appropriated the money, no. It is a violation of the anti-deficiency act's purpose statute. The Comptroller General has made several ruling on such activities. This can be sidestepped. I know if commanders of measly bases can get out of it, I know he can.
