Mitek Cracks Down on Illegal Sales

Tuesday, June 21, 2005 -- Mitek has announced that it will be assisting with a criminal investigation into improper sales of Mitek products from unauthorized on-line resellers.

Mitek has delivered information and evidence concerning a series of Mitek products to law enforcement authorities. The company says the products, from which the serial numbers have been either completely removed or defaced, were purchased from unauthorized on-line resellers. California penal code 537e prohibits the sale of any personal property from which the manufacturer's serial number, identification number, electronic serial number, or any other distinguishing number or identification mark has been removed, defaced, covered, altered, or destroyed. Mitek says it not only seeks to press criminal charges against the resellers, but will also pursue enjoining any authorized retailer or distributor of Mitek products who enters into a relationship with unauthorized third party resellers. Stated Loyd Ivey, Mitek founder, “This is about much more than just the damage this illegal activity causes Mitek. Mitek has a fiduciary responsibility to protect our loyal, authorized dealers, our end customers and all the people who believe in us.” As part of its constant monitoring of unauthorized distribution of its products, Mitek continuously purchases product from unauthorized resellers in order to research its distribution history, the company says. It was during this process that Mitek says it received product with defaced or destroyed serial numbers. The affected products have been provided to law enforcement authorities, along with all pertinent receipts and other evidence.

Continued Ivey, “Unauthorized resellers can potentially cheat our loyal customers by defacing serial numbers, offering counterfeit products, and disallowing factory warranty coverage. We will continue to be diligent in protecting our authorized dealers and our loyal customers from such misleading, illegal, and unethical practices, and do everything we can to help put these criminals in jail. Mitek puts our money where our mouth is.”

 
537e. (a) Any person who knowingly buys, sells, receives, disposes

of, conceals, or has in his or her possession any personal property

from which the manufacturer's serial number, identification number,

electronic serial number, or any other distinguishing number or

identification mark has been removed, defaced, covered, altered, or

destroyed, is guilty of a public offense, punishable as follows:

(1) If the value of the property does not exceed four hundred

dollars ($400), by imprisonment in a county jail not exceeding six

months.

(2) If the value of the property exceeds four hundred dollars

($400), by imprisonment in a county jail not exceeding one year.

(3) If the property is an integrated computer chip or panel of a

value of four hundred dollars ($400) or more, by imprisonment in the

state prison for 16 months, or 2 or 3 years or by imprisonment in a

county jail not exceeding one year.

For purposes of this subdivision, "personal property" includes,

but is not limited to, the following:

(1) Any television, radio, recorder, phonograph, telephone, piano,

or any other musical instrument or sound equipment.

(2) Any washing machine, sewing machine, vacuum cleaner, or other

household appliance or furnishings.

(3) Any typewriter, adding machine, dictaphone, or any other

office equipment or furnishings.

(4) Any computer, printed circuit, integrated chip or panel, or

other part of a computer.

(5) Any tool or similar device, including any technical or

scientific equipment.

(6) Any bicycle, exercise equipment, or any other entertainment or

recreational equipment.

(7) Any electrical or mechanical equipment, contrivance, material,

or piece of apparatus or equipment.

(8) Any clock, watch, watch case, or watch movement.

(9) Any vehicle or vessel, or any component part thereof.

(b) When property described in subdivision (a) comes into the

custody of a peace officer it shall become subject to the provision

of Chapter 12 (commencing with Section 1407) of Title 10 of Part 2,

relating to the disposal of stolen or embezzled property. Property

subject to this section shall be considered stolen or embezzled

property for the purposes of that chapter, and prior to being

disposed of, shall have an identification mark imbedded or engraved

in, or permanently affixed to it.

© This section does not apply to those cases or instances where

any of the changes or alterations enumerated in subdivision (a) have

been customarily made or done as an established practice in the

ordinary and regular conduct of business, by the original

manufacturer, or by his or her duly appointed direct representative,

or under specific authorization from the original manufacturer.

 
and it says nothing about woofersetc.

It does not name any stores because its not only woofersetc.com doing it its all the online stores who are not authorized.

Do you even know who Woofersetc.com is? Do you know who owns it?

I can name you the place where there warehouse is, who runs it, what company they own besides woofersetc.com and who owns it.

So you're saying that my tenor mouthpiece, the one that cost me 450 bucks, that was worked on by one of the best sax techs in the world, which had the serial number rubbed off when he was refacing it, is now illegal for me to have? Fck that.

Sorry, that s/n stuff is total BS. I buy most everything from local retail.. I got nothin against e-tailers though (most ppl know the risks..)

I think that is the least enforcable law I've ever heard of. Almost as bad as marijuana being illegal. well it appears that the rockford fosgate corp. is cracking down on unathorized internet sales as well . I listed a sub on ebay , I used one of their woofer pics , and since it was a new woofer I listed it as "brand new" , a day later I got three emails saying the auction was cancelled and that I could possibly be sued if I listed it again . to me this is funny cause it seems to me that everyone and their brother has a pile of new rockford crap for sale , where they get it I dont know . but when I want to sell something I am a criminal .
