Speeding Ticket Question.......

Im Da *** Man!!!
so i finally got my first speeding ticket yesterday but i have a quick question. the street that i got pulled over on has no speed limit sign, so i assumed it was 35 since it was non residential an headed towards a highway. i was doin 40 when i saw the cop an he pulled me over an what not. i did realize that there was a speed limit sign but it was about 40-50 yards past where i was clocked at. how am i supposed to know what the limit is when there is no visible sign within the region i was clocked.???

 
if the speed limit sign is hidden by trees or brush, etc, take a picture of it and then contest it. you might get your fine lowered for only being 5mph over rather than 15 or w/e it was. if the sign was in plain view and you just didn't see it, well you are shit out of luck my friend

speedometers on MOST OLDER CARS have 5-10% error reading.

10% error of 40mph is just about 35mph

if you have a mechanic friend have him right out a paper stating he did a test on your car and it has an acceptable error of reading caused by speed sensor cable on your car.

itll work trust me.

it wasnt in plain sight. as i stated, there was a speed limit sign posted but it was 40-50 yards beyond the point i was clocked. now that i think about it, the sign was that distance from where the cop was sitting. when he clocked me, it could have been 70-80 yards from me. but nowhere before that only sign, is there a limit posted.

File for a court date... 4 days before court re-schedule your hearing.. by then the cop will already have scheduled a day to take off for your hearing, odds are he won't take off another day for you.

do you have a GPS??

GPS is 100% accurate
GPS is not 100% accurate, normal GPS recievers can place you anywhere within 10 meters of your actual location. And they will still say you are with 6 feet or whatever.

To fight the ticket, take a video of the road from where you turned on to where the cop pulled you over, showing the lack of posted speed limit.

Also, the rescheduling thing does work. At the very least it gives you several months to prepare a somewhat reasonable case. Also, if the cop doesn't show you are immediately aquitted. And if he does, question him about your car, what color is it, does it have stock rims, is it four door, do you have any large bumper stickers. Pick obvious answer questions, that can be identified on a picture. When the cop messes them up, ask the judge to aquit you because the cop does not have a clear recollection of the event. You can ask any number of questions, things he wouldn't know, but should have observed.

 
It doesnt matter if the sign wasnt posted where he clocked you. as long as there is a speed limit sign on that road it is your responsibility to know the speed limit. Some of the ideas listed can help you get out of it though.

 
as a driver you're supposed to know what speed limits would be found in what kind of areas...

like highway construction is 45 unless posted otherwise in michigan, residential is 25 in michigan... stuff like that. usually speeds aren't lower than normal. for instance, in michigan 4 lane main roads are 40 unless posted otherwise, so if you always do 40 in a 4lane main road you won't be speeding. exceptions to this are downtowns, construction and things of that sort.

my advice? write your magistrate a letter saying you can afford to pay the ticket, but you can't afford the points on your license. pay the 100 dollars or whatever, and be happy you didn't get any points on your license and lesson learned.
