Really didnt know what to title this thread, but i have a couple questions about my current landlord etc.

A year ago i moved from Ne to Tx for work. My credit is bad so i decided to check out Craigslist for a room to rent. Found a room with this kid and his mom in this huge house. I rent out the master bedroom which is pretty much a studio apartment. I paid $500 montly for the first 7-8 months with all utilities included, then i was asked to pay a little more which i had no problem with, then 3 months ago my girlfriend from Ne moved down to texas to continue our future and i agreed to pay $600 monthly all utilities included.

anyways, about a month ago, i was told he was thinking about selling the house so we started looking for a apartment. We found a apartment for July and all was well, then talking to another roommate last friday that he also rents to i found out we were suppose to be out by june 1st. So i called and asked him when and he said sorry forgot to tell you, but yes you need to be moved out by 1st of june. this is a huge problem cause all the apartment(probably 20+) were full till July. I have no family or anything here so when he told me about being out by this week, i literally thought i might be on the streets if i couldent find anywhere for my girlfriend, dog, and myself. Anyways, we got lucky and found a apartment that had someone cancel and was approved for that.

i also found out, that this whole time i thought this kid and mom owned the house we are living in, when the whole time he actually has been renting the house, then renting rooms out? is that legal? and how long of a notice is he suppose to give me before making us move out? 10 days? Our writtin agreement says i was suppose to give him 2 weeks notice before i moved out, but its ok for him to give us 10 days?

another thing is that the apartment we got cant let us move in till june 4-5th considering they have to clean etc after the current tenents move out. So he asked me to pay $80 for the 4 days we stay here. I told him considering he gave me a 10 day notice to find a place to live in a state i have nowhere else to go, he should understand i gotta pay rent and deposits to move in.

I have no idea if any of this is making sense because ive been drinking, but is it even legal to rent out rooms when your actually renting yourself? And if all rent is paid etc, how long of a notice should he give us to move out?

 
It is up to his landlord to decide whether or not he can sublease. It should be in the lease he signed. If I were you I would find out who his landlord is and ask them if they agreed to let him sublease. As for him giving you a 10 day notice to move out, it doesn't state in your lease how much notice he's supposed to give you to move out? Most places give you a 30 day notice of when you have to leave to give you time to make arrangements on where you're going to live etc. 10 days isn't a reasonable amount of time to give someone to move out. I don't know if it's something you want to pursue in court but if he ends up kicking you out you may have a case for illegal eviction. But if I were you I would definitely check and see who actually owns the house and if they know he's subleasing rooms in the house.

 
It shouldn't really matter who is allowed to legally rent to you or not. At this point you have established residency and to my knowledge every state has eviction processes that will benefit you in this case. They all have to give you X amount of time to move out and inform you in writing. You have to check what that X equals in your state.

You could have been staying there completely free all that time and still be protected for being allowed to setup residency.

id stay in a CHEAP hotel, cheap weekly rates
yea i know, i looked at some, but they are all $175+ weekly, and i dont wanna waste the money. I have no family or anybody else to stay with, but luckily we found a place. It just pisses me off that he gave me a 10 day notice and now expects me to pay him rent for the 3-4 days this week until the apartment is ready to move into. And also pisses me off that he made it seem like he was the home owner the whole time we lived here, and now i found out he is renting as well.

i thought about that, but she wasent having it.
find out who the land lord is and ask him if they were allowed to rent to u...also find out the price of the monthly rent....
I was thinking about this because at first i paid $500, then he seemed to be around the house alot so i think he lost his job or work slowed down so he asked me to pay another $50 monthly if i could, and i did to help out. Then i told him i would pay $600 montly when my girlfriend moved in to help on utilities, but he is always asking for more money.
yesterday when he asked me for the money to stay here for the 3-4 days, i told him that considering he gave me a 10 day notice, he better understand that im not giving him any money. told him i gotta have my first months rent and deposit for the apartment.

 
I'd be pissed as hell if I was you.
I dont like moving out in a hurry, it is a f-ing hassle.

Hope things will steer back on the course soon for you.
You know, im pissed, but im glad im getting my own place. As long as he dont try to ask for money this week or anything ill be good. lesson learned, done deal. I just wanted to make sure i was right about the way he handled things.
