Here in MA they did consider it a moving violation can't remember if it was 2 or 4 though (here in MA) a buddy got a DUI years ago and remember it being part of his insurance raping after it.

I never felt bad for him because he was drunk as shit, if you did not get arrested for it you must have been ok to drive so I feel for you man. Dumb *** state rules but I would not worry yet Cali may be different.

California Vehicle Code 23223 is the law against possession of open container in motor vehicle. This VC basically states that no driver or passenger shall have in his or her possession, while in a motor vehicle upon highway or on lands, any bottle, can or other receptacle containing any alcoholic beverage that has been opened.

It does not appear that this violation of the CA law carries any points but comes with other penalties such as a fine. So while points may not be assessed, the infraction will likely be reported to the California DMV so that it will be added to your driving record.

damn man thats a good way to go out on the night but the ticket here in IL an open cantainer is 150 for the first offence
