He wouldn't go to jail because it's a misdemeanor due to the small amount of money but he would still be tried and convicted for a crime. You have been arguing he didn't commit a crime.

But he didn't ask them to donate it. If I say my leg is broken and people send me free stuff, but I don't ask for it, it's not illegal.I didn't say, please donate stuff to me because my leg is broken. He didn't say, donate stuff to me because my daughter died.

But you are right. He could get those things but then again it is really up to the judge. He could say that there was no intent for the receival of gifts under false pretenses and say not guilty. He could say guilty of misdemeanor fraud and give him probation and community service. There are no sure things in the American legal system.
