Lawsuit, what do you think?

I thought he had a stroke not a heart attack? Well I would seek advice from a doctor working at a different hospital than the one he went to. First bring in any paperwork that he received when he was diagnosed with a spider bite and then bring all his records so the other doctor can look and the original diagnosis from his symptoms and comare them vs. what happened (his stroke and having three operations) and see if he thinks there was a correlation between the misdiagnosis (if it was) and his further problems. Then I would go from there. The new doctor's opinion could be used in trial if he is willing to testify.
been there done all this. 2 different doctors willing to testify..when he went to AGH the doctors couldnt believe the guy diagnosed it like that it was like a big thing there.

 
Key thing everyone is missing when they say someone is an a-hole for suing.

If this guys dad can no longer live life as he did before because of a Dr. trying to hurry someone out the door, wtf wouldn't he be entitled to something for that? Obviously if he ended up with a hangnail thats one thing, but a stroke/heart attack? So if he's no longer able to perform the job he was once at, can't drive a car, or be a providing head of household...he should just file a report???

I don't know what the situation is and I know he opened himself up for opinions like that, but maybe consider what someone may not be saying. I'll shut my pie hole now.

Actually its high due to people with phony claims or people who sure beacuse their prescription for ED gave them a boner for like 4.5 hrs not just 4.

Basically frivolous (sp???) lawsuits cause the insurence costs to skyrocket. This is a legitimate claim and best of luck to your father and urself.

get what u need(not want) and be done with it, I got food poisoning(sp?) from a local restruant but didn't want to put them out of buiseness so I just got lost wages and medical bills. My sister-in-law is a doctor and the city she is in has seen nearly all surgeons and a large portion of the doctors leave because of the cost of malpractice insurance. They move to another state where it is lower and then most of her patients are out of luck. There is a 10 month wait to see one particluar type of doctor because there is only one left within something like a 50-mile radius. F****** lawyers are why all types of insurance rates are up. Lawyers looking to keep getting richer and richer. Most of the time the patient doesn't see a lot of the money.

But, doctors don't have the luxury of messing up when it is someone's life. Although, them getting people in and out is not always their fault. Hospital administrators want to get patients in and out as fast as they can; the more patients a doctor sees the more money the hospital makes. If a doctor spends 30 minutes with a patient the hospital makes the same as a doctor seeing a patient for 5 minutes. Do the math. Insurance companies want to keep their profits up by limiting the services and tests they will pay for so there is pressure on doctors from both sides to limit what they are able to do.

If the doctor was an a-hole and really didn't treat your dad then sue him to cover the doctor and hospital's screw-up. Your family might get the hospital to settle out of court without hiring trial lawyers but you run the risk of getting screwed again. If you go to a lawyer whatever extra you could win in a lawsuit will probably go to the lawyers anyway. Whatever you choose you get screwed at least once again. Maybe sue the hospital for the majority of the compensation.

(There is a Good Samaritan Law that protects everyday people in the event they try to help someone so that they can't get sued. )
