last friday i was down at the beach for senior week and got in a small accident. i let a friend drive my car down the street a block to his rental house. the parkign lot is just a big gravel area with spaces on each side, anyway all the spaces were taken so he parked right in front of the house, b/c he only had to run in for a sec to get something. (i had my parking pass on the dashboard for the lot). anyways the dude next door came out, got in his tahoe and backed right into my car. so my friend called me up and i walked down to see what happened. the dude said he was sorry and forgot to check his right mirror and we exchanged insurance information and everything. the guy admitted it was his fault. so we then called the police so we would have a record of the accident. so the cop comes out and ends up saying i was at fault because my car was illegally parked . so on the police report it says that i contributed to the accident and the other guy did not contribute at all. is there anyway to fight this at all. the lot is just a gravel area and there are not any no parking signs anywhere. If this goes through and my insurance has to cover both vehicles how much would my insurance go up? i have an 02 sedan and the left rear door is caved in and he has an 05' tahoe with a very little scratchh on the back bumper. thanks for any help.

A lot of times when someone is backing up and an accident takes place it is automatically their fault (the person backing up). You should be able to win this out, regardless of what the cop says.

unless they back up into your front bumper then they can say you hit them //content.invisioncic.com/y282845/emoticons/wink.gif.608e3ea05f1a9f98611af0861652f8fb.gif but anyway go protest it, you will win the cops a douche...

Regardless, your insurance shouldn't go up for one accident. If it does, your company sucks //content.invisioncic.com/y282845/emoticons/tongue.gif.6130eb82179565f6db8d26d6001dcd24.gif

go to court to fight it.

if you're ever in that situation again make the person at fault sign a peice of paper saying they're at fault.
i didn't think anythign would be a problem, i figured the cop would show up and write a report stating the guy was the one at fault. it didn't even cross my mind that i was at fault

You were not, that cop is just an idiot. //content.invisioncic.com/y282845/emoticons/smile.gif.1ebc41e1811405b213edfc4622c41e27.gif

You're BOTH at fault. Ask your insurance company how much you're gonna get foked. Maybe your buddy can get his insurance to cover it, since its his fault? /thread

his car was illegally parked, how is he not partly to blame? lol

there are times when both people can be cited and both are at partial fault. i hit an illegally parked truck with no lights on on the hwy, ***** was in the middle of the left lane parked watching fireworks. somehow it was my fault.
