Got jacked... what would you do?

That's a nasy situation to be in...if you don't press charges and cut a deal he'll make it a point to come after you for being his b*tch. If you do press charges it's likely he'll get a slap on the wrist and still come after you.
Since you've already gone as far to set up the sale of your goods to catch him, you can't really cut a deal on the side w/him IMO - the cops will press on and prosecute. You're in it to win it now man. You need to press charges and be prepared do deal with the guy when/if he comes after you.

Yeah... my biggest concern no matter what is the fact that he knows where I live. He stole out of my driveway. That is why he also needs to understand I know where he lives as well and there would not be a peaceful end to any further contact between us. Really all I want is my $h1T back the way it was on Sunday, which means I need new equipment as I know what he has already done to it.

 
I think that is the point the OP is making. This guy unless he has a past record wont be going to jail. He will get some fines, maybe some probation that’s about it. I have seen only a few cases like this where the defendant got any real punishment.

BTW be a bit careful how you word your "deal" this can be considered a form of extortion. It sure would **** that after all this you end up being the one in trouble.

Believe it or not the victim can become the defendant because of things like this.

Our justice system allows defendants to turn the tables quite easily. Sad but true and the price we pay for “freedom”

to me i wouldn't make any deal of him having to replace your goods.

maybe i missed out on information from page 2-3 but from what i read on the original post it doesn't matter how well one would know another that would keep them from punishing another person for their actions.

unless if it was someone of my family or of blood then i could forgive and do some sort of deal like you stated. but to some bar buddy that you've had drinks with for a few years while driving an expensive car and stealing other peoples belongings isn't right. he should get some time for his actions.

 
For real, man. The dude obviously seems to feel above things. Press on. Take him to court. Put it on his record. Who gaf how he feels, or what he might do (which will be tough to prove any intent when nothing's on his record).

If he comes after you later, keep piling charges on. He'll either stop, or go to jail.

 
I agree he should get some time... but I seriously doubt he will. The only thing they HAVE him on is possession of stolen goods and selling stolen goods. The evidence that HE STOLE it is circumstantial and he likely won't do any time for it. I am not trying to forgive and forget, just don't want to make any new enemies or be out a bunch of money. Besides, does anyone TRULY believe that he would stop stealing if I pressed charges, but continue if I don't? No, if he is going to steal again, he will do it either way as he won't be in jail long enough to solve the problem anyways. I am just trying to think of options for making the best of a bad situation.

 
to be honest, I used to agree with you. Now, as your posts go on, it seems to me you're being a chump.

For goodness sakes, the man stole your property. He can afford it, if he's driving a corvette. Don't let him get away with a slap on the wrist. Do you really think he's going to come back for you?... please.

 
You might be right, I can see how I would look like a chump here... I just hate the idea of being out another $250 when he can afford it, I really don't need to spend another $250 on that right now, and it might be another 45 days before I can. I know everyone is saying not to let him get away with a slap on the wrist, but what are my options? (LEGALLY) Our justice system is so effing screwed up that he will most likely get away with a fine and probation at worst.

Right now I am looking at spending more of my hard earned money (that I don't have right now) to fix what numbnuts screwed up and I KNOW he can afford it. I think everyone would consider this solution if you were in my shoes. I am usually the type of person to pay money to teach some a-hole a lesson, but I am not sure I can afford to teach him the lesson properly right now. Besides, if he declines my proposal, I can always sue him in small claims court for what I want anyways in addition to criminal charges.

You know what, lets talk about that option. Who has sued someone in small claims, what do I need to do? Can I start that process now? Do I have to wait until the criminal charges are handled? Help me out people, I like this idea better.

 
I say just be happy you got your shit back You could have ended up with a "WTB: ALpine HU" thread, but instead you trying to swindle dude out of some new shit.
Don't get me wrong... I am happy to get it back, but I don't think swindle is the right word for it, he STOLE MY $HIT!!! He won't do any real jail time for it, so I think that some sort of monetary punishment is in order.
