Probably. Is he not responding to email correspondence? If not, you've likely been had, but PayPal "disputes department" favors the buyer (you), so you may still have some leverage.

I hope so i mean he had a bunch of refs but he hasnt been on here and hasnt answered the one email i sent him so he might be out of town...It says that he hasnt been on Ca.com since 11/20/2005...I really hope he didnt screw me out of this
