First time drug offense?

well that's a lie, you can never completely remove anything off of your record.
There is a special circumstance for minor drug offenses depending on age. You are talking to someone who has filled out forms for DoD security clearances as well as someone who has been on the wrong side of the matter. On the clearance form it said list all convictions including those that have been expunged from your record. You can put down nothing without it being perjury if it was a minor drug offense before the age of 21. It is truly like it did not exist.

I know that, I have many things that have been "taken off of my record" but they are still there. They don't show up on your average background check, but I know for a fact there are ways to see them. If you got in trouble for the same thing that was taken off of your record you don't think they would know about it. It is basically taken off of your record, but it is still there. My dad got a ticket when he was like 12 years old, and in his 30's he tried to get a job at Maryl Lynch(sp?) but they saw that on his record and he didn't get the job.

so he should plead guilty? he has never been in trouble before, and is freakin the **** out
He will go to court and they will tell him that if he pleads guilty they will drop it off of his record, he will pay a $100 fine, and will probably have to take a class/ possible community service. I would not call a lawyer or freak out. This is a misdemeanor, and not a big deal at all.

Ok let me rephrase that, it cannot be held against for any manner other than further prosecution. There is a Federal law saying that you cannot be denied anything due to this type of conviction. I forgot the law number but it exists.
 
best thing and judges like to see is if he goes ahead and gets off smoking and starts a drug class and show hes getting clean
No, just wait until the court date. It's not like that anymore and marijuana is becoming very decriminilized across the state. I believe that you can legally posess pot in like 1/6 of states now, and in like 40+ the first offense is a misdemeanor and will cost you about $200 and maybe 24 hours out of your life. He will be fine.

I know what you are talking about and I agree, for all intensive purposes it is off of your record, I'm just saying that a high ranking job for the government or something and it will still show up. Also, in 3 years, if he were to get caught in the same county, they would know that he had already been in trouble for it, even though it was taken off his record
