Court Orders New Trial In Ford Rollover Case

if it didnt work then thats the owners fault for not maintaining their vehicle and have it checked out periodically. I am curious if the truck is auto or manual. If auto then it wouldnt have come out of park without pushing on the brake.

really? I though the gov made it required. God Ford is junk. I like the whole deal they did about they use bigger bed bolts and it increses payload. What shit

My dad's Ford wont shift without the brakes applied.

I don't think they should have to give the parents any money at all... pending the circumstances. I would like to know if 1) the brakes were worn or not adjusted properly, 2) if it was a design fault, and if so, was there a recall, 3)Who the fuck lets their kid climb into a truck and fuck around.

If it was Ford's fault for having a known problem in the design and not issuing a recall, then I think the parents should get something. More than 52 million, though is debatable. If the truck had crappy maintenance and it was due to worn components, then fuck the parents, sue the owner (assuming it wasn't the parents' truck).

I would like someone who has knowledge of this kinda situation to tell me if Ford would be held responsible if there was a recall put out, and the owner notified, but they never came in to have it fixed. Its not like Ford is just gonna show up at your door and be like, "Hey, we've come to fix your recalled brakes, where are the keys?"

 
looks like your basic strict products liability suit...and to the recall situation (to put in very short, basic terms), if the recall is due to a design defect, and the company does not make it "known", then they are liable. there is a formula companies use but its neither here nor there right now...but look up the ford pinto if you want to understand how it all works. Cost of litigation is compared to cost of fixing the problem. Obviously, if its something that puts a reasonable threat of harm onto a consumer, the company is "supposed" to exhaust all reasonable means to put each owner on notice via recalls and such.

That's not Ford's fault... that's like me blowing off my hand with an M-80 and blaming the fireworks company for putting a fuse on it. Jeez.
not quite..but I see your point. an M-80 is a known and obvious danger(and assumption of the risk)...whereas a car is not sold to hurt people. And yes, we all know there is negligence for leaving a kid around, but under a SPL suit, it doesnt matter..it focuses on the product.

A car is sold as transportation. When you buy a car you understand that 1) It weighs more than 10 times what you do and thus it could be potentially dangerous and that same vehicle is 2) Capable of traveling at speeds high enough to be dangerous and that 3) only licensed drivers are supposed to operate said vehicle.

Who didn't lock their doors? Locked doors = no dead kid. Simple as that.

Also, how old was the kid in question here? Old enough to climb into the truck, obviously... but what kinda thoughts did the kid have? Bailing out of a moving vehicle is stupid no matter how old you are... so I don't think he did that... so we have hum falling out. Well if you fall out of a vehicle you're stupid anyway.

Who lets a 3 year old wander unsupervised? Where was this truck parked that it moved while in neutral? Enough to gain speed to crush a child? If the kid had fallen out, and the truck was moving ~5....maybe a broken leg? How the **** did he get directly under the wheel, and the truck actually roll over?
