Bs insurance ticket or not?

This morning I heard a crash, and went outside. I see my car, which was parked on the street..up against the curb..right in front of my house. And my car is totaled. Some stupid beyotch ran into it. My parked vehicle. Now, this is a Chevy blazer s10 1990. Not so easy to bang up. But she completely bent the passanger side wheel into the car...it's undriveable. And the breaks don't work anymore. She hit it head on. I ask her, "what happend" and she said "I don't know I just blacked out..." I was like WTF. She tried to tell me not to call the cops, but I've always been told that you should always, no matter what, call the police in accidents like these things. Well, I wish I didn't Because what followed was ultimate bsness in my opinion.

The cop shows up and from the get-go I can tell he is sididng with the party that hit me ( a mexican woman and her brother in law). First off; the cop asks to see my registration and insurance. Now, I told him "i don't have insurance. I keep this car parked here, I am currently selling it and do not drive it. My brother WAS going to pay for it at the end of this week." And he lets me know I'm going to be citated for no insurance. I was like WTF. Cuz um...The car was parked...I wasn't driving. He said that as long as its on the street it had to be insured; and that if it were parked in the driveway it would have been different. Is this true? Sounds like bs to me... But yet I have a ticket. Now, it didn't stop there. The cop says to the lady "how fast were you going..about 10, 15 mph?" I was like omfg. The speed limit is 25. The story, as the police report says, states she was going 10-15 mph; had a blow out; then slid uncontrollably into my car. But this is SO obviously not what happend. She freakin passed out and hit my car at ATLEAST 40mph, easy. The crash was very loud. And I know her tire blowout was caused by her hitting my car. My car was knocked halfway off the street and into the yard; her car was a good 30 feet in front of my hit car; with a big long burn-out mark trail all the way. If you are going 10-15 mph and blow out you don't slide into a car; knock it into a yard; keep sliding 30 more feet; total your car where a wrecker has to carry it away; and total my car to where i end up letting a buddy pull it away on his trailer for $100 just to get rid of it. This was so bs. She didn't have insurance either. And the cop says its "my word against hers" cuz the car could have been damaged before she hit it or some bs like that. I don't even think there is anything I can do as far as pressing charges; at least it doesn't feel like I really have the option. The cop was totaly on their side in every way. I haave no idea why. I was in my house and my parked car got totaled...now I'm out a vehicle, money for selling the vehicle, and have a ticket for no insurance?

Someone please tell me at least this ticket is getting thrown out?

(btw this is in Mississippi)

you can tell them that in court. those **** pigs wont listen to you. and you already have the ticket. just go in there and hopefully they'll waive it'

and taht ticket is bullshit

 
ACtually, its true you need to have insurance to keep a vehicle on a public road, rather then private property. I.e. driveway.

But the blow out shit is something you need to take to court. Take pictures for evidence, and find past pictures for evidence.

take it ALL to court. pretty sure you can get the ticket waived and money for property damage wether the car was insured or not. she was COMPLETELY at fault in the situatiotion.

 
and you should have taken pics of everything before they moved the cars. did the cops take any pics?
Of course I took pics. But I don't know about going to court. The car wasn't worth much really. It was in bad condition; I was only selling it for $400 so thats not really worth the hastle to me. I doubt you will win the "no insurance" ticket. He is probably right about it needed to be insured while parked on the street. Do you not have a yard? I would have just parked it there if you were selling it. If it was already sold, then why did you have it on the street? No where to park it in the driveway?

The rest is BS and if she didn't have insurance it should be on the police report, so she is screwed as well anyhow. I would go and take the ticket and try to fight it, but plead no contest with an explanation. Then tell your story. They may be able to do something about the vehichle and damages maybe. Have had my ride hit twice at my old house as I didn't have room to park certain nights and would park it in the yard right next to the street and one time I had it taken care of and the other time I had to claim it on my home owners insurance because it was hit and run. //content.invisioncic.com/y282845/emoticons/frown.gif.a3531fa0534503350665a1e957861287.gif

Well, I sold it to my brother. For $400. He wouldn't have the money till the end of the week. So, I was keeping it parked there till he payed for it and I gave him the title. I was gonna use this money to add to what I have now to get a new vechicle and get insurance on it. (now I can't even afford a beater) And it was parked on the street because the driveway can only hold 2 cars, and it was full.
