After the last new menu came out at applebees, my favorite meal that I had eaten ever since it came out was nowhere to be found. Took my menu up to the front to have a genius look at. Claimed that since there was "new" items(which was no more than a few salads and appetizers), that they could not make it unless I paid the $20 fee. Having no choice(needed a meal), and after dealing with a little punk manager at the applebees front counter,I paid it.
So I then decided to both file a complaint with the State Attorneys office and sue Applebees Inc. for failure to honor there previous menu.
Since Applebees did not pay there state corporation tax in West Virginia for the year at the time of my filling, I could then sue them in local county court instead of having to go to state court. And since the amount was under $2500, all I had to do was send them a service of notice in the mail. They received the letter and copy of the lawsuit via registered mail was signed by a employee at 1 Infinite Loop.
Got no response from Applebees at all.
Court date was today. I fully expected nobody from Applebees to be there because there was no way Applebees would hire a local attorney to show up for this. And indeed nobody from Applebees showed up. So the judge awarded me the default judgment in the amount I asked for which was $750(the total sum from the many future meals I will miss out on, and the price of the $20 dollars). Think total legal expenses were like around $90. Around $80 in court costs, and around $10 to subpoena the Applebees Store manager.
So now goes the hard part of collecting. But f*uck Applebees and there new menu.
