anyone here a....

Well, here goes the novel.

I work in the Beer business, i am a salesmen for a distributor that sales a variety of beer, wine, and non-alcoholics. I deal primarly with beer.

So, i moved onto a new route right before Thanksgiving. I get 1 week to learn the route, although i'm familiar with the locations of the stores and i do know the store management already, however do not know the history of the ammount of beer they sale. Now i go into these accts anywhere from 1 to 3 times a week, to schedule their beer deliveries. So in the 2 months of all the holidays, i run into "out-of-stock" issues. So they(Bob- Beer regional manager & Vic- wine reg. manager) talk to me, and ask if i want this job, i tell them that i do want the job and that i had no sales history to go off of, being that the last salesmen did not keep accurate reports in his handheld. They send a veteran salesman with me to see if he can show me any pointers. From this veteran, he tells me that Bob and Vic asked him how long it would take him to get this route undercontrol, he replies with 3months. So another month passes everything is going good, my orders are better, the accoutns seem to be happy. All is well in my mind.

In Feb. my son got ill and was diagnosed with Wilms Tumor, we spend roughly 3 days in a local hospital, and 11 in Childrens hospital in Seattle. I call work and let them know that i won't be in and don't know when i'll be back yet, i explain that my son is sick and etc etc.

I come back to work mid Feb. and Bob's dad is very ill and ends up dying a week later, now we're in late feb. early march. When he comes back, he has a write up for me, he says while i was away with my son they did a clean up on my accounts and brang back "X" ammount of adead beer. I sign the write up but i'm thinkin WTF. So i tell him that part of my sons treatment is Kimo every Friday in Seattle for the next 6 months. They say okay. A couple of days later i am in the office and they(bob and vic) into bobs office and say that, the company had raised money for my son and that it's in a bank acct. and they're trying to figure out a way for me to access it. I say okay and continue my day.

A couple of weeks later i recieve a write up again for having "X" ammount of dead beer. By now i'm seriously like WTF. Now i'm getting paranoid and wondering if my jobs on the line. A few days go by and i get a random UA..... no stress here since i dont' do drugs and i quit drinking, no biggie. i go to my regular scheduled kimo for my son on friday and get a text message from my district manager, saying that i need to go talk to Bob at 7am on monday. i dont' ask why i just say ok.

I go to bobs office at 7am, and he tells me....jeremy i had a list of reasons on how u disappointed me but i don't think u wanna hear what i have to say, so i'll say it like this," u can either resign or go to merchandising", he says i'll give u monday off paid to think about it.

Tues. morninig i show up at 7am and give him my handheld and all it's accessories, and he says so i guess ur resigning, i said i guess so, i have no choice, i'll be merchandising, i have no choice. i tell him i have appointments today and will not be attending work today. Now we're at Weds of this week, i go to work as a merchandiser, i get a call from my Merchandising manager Jose, saying i need to see bob after work, i say okay....now i'm thinking WTF now.

Jose and I go into bobs office and he asks me to shut the door. Again he starts in on the "how u disappointed me". earlier in the day i was talkin to jose about my days off, cuz every merchandiser has either weds/thurs or sun/mon. off, jose told me i'd have sun/mon off and fridays. Now bobs first question was, did u guys decide on what days u want off....friday and what other...i say well i was told this morning i'd have sun/mon and fridays by jose, bob then says to jose, i thought we talked about this, he was supposed to have fridays off, and jose replies, yah sun/mon and fridays. bob seems abit irritated and i'm already edgy cuz i don't like bob. I ask him how can he put me to merchandiser and drop my pay, isnt' that against the law? he says no, grocery stores do it all the time. i said but u put me to merchandiser, u said resign or go to merchandising. i now am telling him in a very stern voice I AM NOT QUITTING, LOOK AT ME........ I AM NOT QUITTING. he says something to the sort of tough ****. i then say we'll see about that. he then goes do u think this is the first time i've done this, i reply with a no bob i know u have........he says this ain't my first go around, i again reply with a no bob i know, people talk. by now he's irritated and so am i. he then tells me that if jose comes to me and says that u've done 1 thing wrong, your terminated...i reply with a " i expect this from u bob" he keeps stressing the point of me messing up once and i'm terminated....i ask him if he's threatening me, he says yes i'm threatening u, i'm explaing to u wahts gonna happen. then tell him, since i'm not sales anymore, do not call this phone(showing him my cell phone), u or any other member of staffing, he looks at jose and asks, don't merch's. need to have phones?....jose is like ummm...i dunno i don't think so, bob then looks at me and says, if i call u or anyone else and u do not answer, u will be terminated, i ask if we're done he says no, i got one more thing for u......he tries to hand me a manila envolope with my sons name on it......i tell him i'm not taking it, he says it's for my son, i repeat i'm not taking that, he says "it's not from me, it's from the company", i tell him " take that money and go buy yourself something real nice". i now ask, am i done now? he says yes....then i leave by saying " don't u try to talk to me or call me, if u have aythig to say u can tell jose and he can tell me or u can tell my lawyer".

i know it's a long novel, but i need help from someone who's been through this or is really familar with FMLA. I honestly feel like i could be fired any day, i contacted a lawyer and have an appt. on weds. I mind u i've worked for this comapny for 4 yrs now, and have been a salesmen for 2.5 of those. we have a high turnover rate for office staff and sales staff, i have 5 letters from previous salesmen and will get more from previous office staff/management.

 
Honestly though I don't know man I would be working on a plan myself looking for another job if I were you. Only sounds like a matter of time, at least you can get Cobra health insurance for a while if it takes some time to find another job.

 
lol well if that were the case, i could get millions.

but in all seriousness, i'm not looking for a payday, but i do want Bob fired for being a heartless P.o.S. if money should happen to come my way, lol i woudn't turn it down being in the situation i am in.
