Accident: Who's Fault is it?

can you contest the tow? You never asked for it so they shouldnt be able to charge you for a service you didnt request. Also, it should be his fualt, if you were in a travle lane and he was merging from a on ramp, it should be his fualt. Did anyone get a ticket and if so what was the violation? It sounds like the person who hit you should have a ticket for failing to yeild the right of way. If he does that allready says whos at fault. If you got a ticket for it, his insurance is gonna say your at fault. You were driving striaght, he came from a onramp, and merged into you... his fault if thats the case.

Botton line: Blinker or not, he has to yield the right of way. I see people driving around all day with their blinkers left on. Until you leave your lane, he must yeild. If the insurance company calls, just tell them the facts. You were driving, you never left your lane, and somone pulled out in front of you. If they give you shit, tell them youll see them in court.

dont even say they pulled infront of you... infront implies that you rearended them.. you got side swiped.
