Paypal add "3%" rule illegal?

Not to mention alot of people dont think about it but any time you use a visa mastercard etc at a store or anything. The seller, store, mechanic etc they are all charged that fee, for accepting payment.
Debit cards included. Which is why it's a horrible idea for a business to accept them. The customer could just as easily pay you in cash (no fee) or check (much smaller fee).

And yes, there normally is a small fee for a business to deposit a check into a business account. The federal reserve charges the bank for processing any check deposited into a business account, and the bank normally passes this charge on to the business monthly (it's very small...the fee varies by type of check [out of federal district, same federal district, same bank, etc], but all are less than $.40)

charge an additional 3% for shipping / handling and your covered. hell why not just make it 4%
Still can't do that since it is "operating" as a surcharge //content.invisioncic.com/y282845/emoticons/wink.gif.608e3ea05f1a9f98611af0861652f8fb.gif Technically.

UPS is generally more money than others. Going to the Retail UPS Store makes it even more.

offer a 3% discount for USPS money orders //content.invisioncic.com/y282845/emoticons/wink.gif.608e3ea05f1a9f98611af0861652f8fb.gif

As a side note....it is illegal to add a surcharge for accepting a credit card or paypal as payment, but I do not believe it is illegal to have a discount for paying in cash/money order //content.invisioncic.com/y282845/emoticons/wink.gif.608e3ea05f1a9f98611af0861652f8fb.gif
Technicalities. It's all in the wording.
Already covered that in Post #6 n00bx...

Hi,
I just posted up computer sales in another forum and put paypal users add 3%. One guy posts and says it violates the user agreement for the paypal. Now personally i really dont care that people post up "paypal users add 3%" and that its up to them, but is this true?

Heres the users agreement link http://www.paypal.com/cgi-bin/webscr?cmd=p/gen/ua/ua-outside
It's like retail establishments that accept CC payments. They aren't allowed to charge more to CC customers to cover processing fees. Paypal is goverend by the same rule and Ebay pulls auction that state this. To avoid getting burned on small transactions small brick and mortart shops won't let you use CC for anything less than a $20 sale to make sure the profit margin covers the baseline processing fee //content.invisioncic.com/y282845/emoticons/wink.gif.608e3ea05f1a9f98611af0861652f8fb.gif So yes, technically it is illegal to ask people to cover your paypal fees and is stated in their TOS, however noone is going to crack down on some private deal on a forum. On Ebay however it is frowned on and they can and do at times pull auctions for that reason.
