Hit by cone, is the city liable?

My g/f was on her way to work today when the lady in front of her hit a cone that was in the middle of the highway and it flew back and hit my g/f's car, jacking up her clearbra and scuffing the paint off the one tiny area that isn't covered by the bra. Is there any liability on the part of the city for damages to your car because of their equipment? If so, who do you contact?

I'm pretty sure it is considered a road hazard, just like if a rock cracked your windshield. She should have caught up with the lady and tried to get her to admit it was her fault and convince her to pay for it

 
i doubt u could pin it on the other lady....she didnt exactly hit it on purpose im sure, not likely she aimed it perfectly to your girls car either.

no, but it isnt like she hit it and said **** you and put it into your windshielf. if someone told me that i broke their bumper because the cone i hit, and they were behind me, id tell them sorry they have to be in the same boat as me.

id laugh in their face if they wanted to pay for it.

hitting someone from behind or something of that nature is different than u hitting a cone on accident and it oddly enuff went into her car.
