Priceless, President Bush is in trouble with the RIAA.
p2p news / p2pnet: RIAA (Recording Industry Association of America) chieftain Mitch Bainwol today hand-delivered a p2p file sharing subpoena to US president George W. Bush, say sources.

George W. has been video-taped openly admitting he plays music by The Beatles on the BushPod.

The Big Four Organized Music cartel's RIAA is now after him for stealing copyrighted downloads.

"We have to be seen to be scrupulously fair," says Bainwol. "We've subpoenaed more than 18,000 men, women and children for doing the same thing, so we can hardly ignore Predent Bush's transgressions, even if he is our leader."

Recordings by The Beatles are sacrosanct and the remaining Beatles have only just agree to allow the band's works to be posted online.

Even given that the President may own original copies of all the albums on his Ipod, it is still illegal to copy any copyrighted record in any form. Just like with movies "back-ups" and copying the media to other devices is still considered piracy even if for private use and is prohibited.

They only "legal" way to have songs on your Ipod is to download them from a online site like I-tunes. However, has pointed out, it would have been impossible for the President to do thiswith the Beatles records which have only been avaliable for download after this interview.

RIAA Says Ripping CDs to Your iPod is NOT Fair Use

It is no secret that the entertainment oligopolists are not happy about space-shifting and format-shifting. But surely ripping your own CDs to your own iPod passes muster, right? In fact, didn't they admit as much in front of the Supreme Court during the MGM v. Grokster argument last year?

Apparently not.

As part of the on-going DMCA rule-making proceedings, the RIAA and other copyright industry associations submitted a filing that included this gem as part of their argument that space-shifting and format-shifting do not count as noninfringing uses, even when you are talking about making copies of your own CDs:

"Nor does the fact that permission to make a copy in particular circumstances is often or even routinely granted, necessarily establish that the copying is a fair use when the copyright owner withholds that authorization. In this regard, the statement attributed to counsel for copyright owners in the MGM v. Grokster case is simply a statement about authorization, not about fair use."

For those who may not remember, here's what Don Verrilli said to the Supreme Court last year:

"The record companies, my clients, have said, for some time now, and it's been on their website for some time now, that it's perfectly lawful to take a CD that you've purchased, upload it onto your computer, put it onto your iPod."

If I understand what the RIAA is saying, "perfectly lawful" means "lawful until we change our mind." So your ability to continue to make copies of your own CDs on your own iPod is entirely a matter of their sufferance. What about all the indie label CDs? Do you have to ask each of them for permission before ripping your CDs? And what about all the major label artists who control their own copyrights? Do we all need to ask them, as well?

P.S.: The same filing also had this to say: "Similarly, creating a back-up copy of a music CD is not a non-infringing use...."

Things are getting pretty bad when the RIAA has more power over such things than the President.. Maybe it will take a lawsuit against Bush to force the gov't to make the RIAA change their monopolistic ways.. I mean, ILLEGAL to copy your own CDs to your iPod? Come on now.. Who are the real criminals here??

**** the RIAA.. Don't they have anything better to do? Don't they make enough money already? **** em, I say..

wow I'm suprised the anti-bush crowd isn't suddenly pro RIAA... we'll see how this plays out... maybe it'll do them in on their **** legal attacks with the president potentially on the p2p side... how very interesting... if I was the RIAA I think I'd ignore his filesharing to avoid a more scornful government position on thier lawsuits.... then again I've never thought much of the RIAA even if I do think d/ling from p2p's without owning the CD's as stealing (under current law)... even if I can't say I've never done it myself and that in the long run it could be beneficial to a more intelligent RIAA who uses the phenomenon to thier advantage... anywho.. we'll see...

The RIAA thing is ridiculous though. It is beyond me why you can't rip your music on to your iPod or computer. I do understand that record companies want to save their profits, but if you buy the album, you should be able to play it where you want to, it's yours. Just my .02

 
There is a war raging between the entertainment industry and consumers. They would love to take away the rights and principles granted to consumers by history and specifically the betamax case, and are using every tool that billions of dollars and political contributions can buy. The sad fact is most people don't even know what the fuck 'fair use' is and how they are slowly taking it away. Groups like the EFF are our only hope...well besides the newly restocked supreme court //content.invisioncic.com/y282845/emoticons/crap.gif.7f4dd41e3e9b23fbd170a1ee6f65cecc.gif

If you follow the progression of copyright law from its original principles to this point in time, there has been a huge erosion of consumer rights in recent years. I mean just look at the dichotomy of the DMCA, which grants fair use rights yet criminalizing circumvention of any drm to gain access to legally acquired content.
