The Wistles Go WOOOOOO!
Ok heres the situation.. i made a myspace a while back and of course i put up pics of me holding various alcohol containers (in the more pics member section). i didnt think it would be a big deal since our school isnt searching them and my towns police arent either.

well more and more schools are suspending people (see other myspace thread) and so i decided that since im lookign for a job maybe its best i dotn have that stuff up.

well that was two weeks ago. and for the record, i live in Swanton, i go to a private hich school, while my friends live in Perrsyburg (my old town) and they go to Perrysburg high school.

Now to the point, i find out in the middle of the day today that theres a flyer going around perrysburg high school with a picture of me (and a perrysburg student) holding up a bottle of tanqueray. the flyer is for parents to come to an informational teen drinking meeting.

the perrysburg kid complained so the school is taking them down, but was it legal for them to put that up int he 1st place?

is that not some form of privacy violation of defamation of character or something of that sort. everybody and their mother now has this picture of me and the bottle and people are obviously talking. what are the laws? was this action legal since i had it available to veiw online?

(please dont flame i knwo its my fault for all this and i dont even care that much everybody drinks anyways im just pissed that they would use my picture without consent like that)

you ever see the shows that have peoples faces blurred out? Yea they didnt give consent to show their faces on tv, im thinking the same situation here, there has to be a lawsuit in place for you, no way they can do that.

Completely legal sorry buddy. Upon sharing that picture online. It instantly became public property, and no consent would be needed for the use of the picture.

To bad you were drinking crap...

100% correct.

The act of making it publicly accessible is a form of unspoken, unwritten consent. You placed that picture in the public domain to begin with so it would be a bit tough to cry 'foul' at this stage in the game now that the picture in question is being accessed by the public for their own purposes...

I'm pretty sure that they can use that picture as it stands, but I thought there was a law where as long as the source pictures were taken down (the ones of you drinking on myspace) that it would then be illegal for them to use it for anything.
